On 9/14/07 I entered into a 12 month lease for an apartment. I was not aware, nor did the proprty manager tell me, of a train that goes by 24/7 practically right next to the building! The horn prevents me from falling asleep and wakes me up from sleep as well. Is there anything I can do? I cannot live this way for the next year!

I measured my property and it was only 29 feet and 2 inches. Land lot for my zone states 30 feet. This extra 8 inches would make my driveway easier to get into. How can I found out who is responsible. Also is it possible for the other property to have been grandfather din? Tried to get a survey from 9 years ago from Intracoastal Abstract- Title Company and they said they don't have the survey on file anymore. Don't want to get a new survey. So now I’m stuck with a narrow driveway and I am not sure how to get my total 30 feet of property back. Please Help!

The price was listed very high..the seller has been dropping the house at an avg of 10k a month! I found out the builder is going to be foreclosed on..and there have been no other offers except one in July but it fell through..last night we offered 30k below asking price and he countered with the original price minus landscape and appliances..which was nothing much at all..so basically the original price. We went up by 7k he again came back with the same price. We are giving our final offer today. Which will be 15k below his asking price. If the bank is foreclosing on him..wouldnt he want to take the sale? We are a clean sell..no other property..and he doesnt have to buy appliances etc for it or fix up the yard like he might for other buyers. I just cant understand this since no one has made and offer... IS THIS CRAZY??

Our Landlord has served us 2 months notice because of late (never unpaid) rent. We are not behind on the rent now, though it has been paid late, due to financial difficulties. I was wondering if we are legally required to leave on the date, with only the notice served. We have an assured shorthold tenancy for a year, ending in February and the end of notice date is November. Any advice is very appreciated Thanks.
Please don't tell me to go to the CAB/Social services, I know I have to but can't afford to get there yet. I know the council can't help us as I have friends that work there who told us. Thank you xx:)

The renter says he had trouble previously because he had been in a coma for 6 months and presumed dead. Now wants me to be his legal guardian and have the $1600 check deposited. $1600 is what he paid for his last condo rental.
It sounds very strange, but is it illegal?? Am I helping him launder Disability money?? Is this a common type scam?? What should I do or what to ask him for in order to see if its legit??

We bought a house for 210K and wont be able to pull the payments in like 5 months cuz I'm having a baby and i won't work during that time. We got a 7.35% on our mortgage and heard that if we sell and buy another house right away we could get a 5.something percentage. The reason we don't want to keep this house is cuz of payments and it a lil fixer uper and we were thinking about fixing it, but we won't be able to have money for all the permits and stuff. So, we want a house that is NOT a fixer and is for a reasonable price, but should we buy now? Wait? Howz the house market? Thanks guys cuz my hubby and I are confused! :(

My landlord sent a certified letter from his lawyer stating that I had 30 days to put my 22 year old son out. My son is not named on my lease (which) I drafted, but there is no statement regarding someone moving in either. I didn't tell my landlord when my son moved in. He asked me shortly after if my son was living with me I told him yes and that it was temporary. He stated that my son was not on the lease to which I reinterated that it was temporary. He said o.k. My son has been with me for a little over a month. A couple of weeks ago my landlord approached my son and told him it was time for him to go. He was very nasty about it. He has not mentioned anything to me at all about having a problem with my son being here. My landlord and I are at odds over his unethical behavior i.e. substantial rent increase, changing locks w/out notification, blocking front steps for repari w/out notice, etc. Where can I find laws that speak about a tenat moving some in.

It's been almost 6 1/2 weeks since the buyer signed the sales contract and given the earnest money deposit in escrow and still no inspection date is set nor is an appraisal is ordered by their lender. They showed us a pre-approval letter and we felt comfortable with selling to them because they were pre-approved. What is the hold up? We set the closing date for Dec 19th, 2007. I sold one of my bedroom sets and livingroom furniture already and holding yard sales to sale to the rest of the things and now this sale seem like it's going down hill. I have another house building and is depending on the sale of this house to cover the new home. I just find it a little funny their lender have not took this process futher. The buyers excuse is they are shopping lower rates. The realtor is their best friend and they have been friends for 20-something years. I think the buyers realtor is covering them. I do not know what to think about this sale? Maybe I don't really have a sale?

I loaned a relative money to keep his home from Foreclosing. Can I put a lien to protect my interest in the property in case something happens to him? He does not have a will and is not officially divorced from his spouse, so if something happens to him, SHE gets everything and I am out a LOT of money? If I can do this, how do I go about it?

I am finding mice droppings all over my rental apartment. My landlord was supposed to sent the "exterminators" in today to get rid of the mice. When I walked into my apartment today, I did not find any mouse traps. When I questioned the landlord he said that the "exterminators" were in today and have sprayed the apartment with something that if the mice smell it will kill them. I have 2 questions: 1 ) Is there such an "anti-mouse" spray on the maket? #2) Is finding mouse in my apartment ground to break my lease? Thank you.

Jane rents an apartment from XYZ Corp. Her lease does not permit sub-letting. She sub-lets a room in her apartment to me. We have a very basic one page rental agreement. After I move in, Jane asks me to lie about renting the room from her ... to tell people that I am a friend that is just there occasionally. I am uncomfortable with this and now wish to leave the apartment immediately. Jane is adamant about holding me to the 30-day notice in our "rental agreement".

Is this agreement even valid or legal, since subletting is not allowed in her lease with XYZ Corp (the owner)? How do I get out of this bad situation? She is also holding a one-month's deposit.

Hi.. I am a recent landlord and have had problems with my tenants in which I have asked them to pay for damage to my property. They have since written me a letter back saying that will not pay for the damage because they feel they are not at fault. The issue is the washer machine they installed aparently was installed improperly due to excessive water under the washer machine leaking to the first floor ceiling causing 6k in damage. I have hired a contractor and plumbing both confirming there were no signs of leaking pipes and thermal images from the contractor shows water originating from the laundry area directly under the washer. What are my next steps for claiming money to pay for the damage the tenants have created. I have already payed for the repair of my home.

I am aware they want me to pay $2150 for breaking the lease or pay the remaining months (3). This way though they will be getting my 2150 dollars plus 868 if another tenant replaces us. If another tenant takes our place can't they reimburse us (partially) if we pay 2150 or if we decide to remian stop us from paying rent since the new tenant will take over?

My realtor said I had to pay for house insurance one yr in advance, which on the closing day I did. But when I get my mortgage payment stub, on the Escrow account it says part of the payment will go to house insurance, why is that? Am i paying twice for it?

The lease says I am responsible for yard maintenance and so I mow the lawn and trim the hedges, but these are big maple trees we're talking about (30+ feet tall) and will require hiring a professional tree service.

I am currently on a home title with an ex fiance and I was wondering since I have been paying the mortgage on the house and the property taxes (he is not living in the house, I am in pocession) for 2 years going on 3, when the home is sold, can i take more of a cut of the profits since I am the one maintaining the house, and paying the above? Also If I add value to the house by doing improvements, can I take a cut from his profit of the sale of the home as well?
