Jane rents an apartment from XYZ Corp. Her lease does not permit sub-letting. She sub-lets a room in her apartment to me. We have a very basic one page rental agreement. After I move in, Jane asks me to lie about renting the room from her ... to tell people that I am a friend that is just there occasionally. I am uncomfortable with this and now wish to leave the apartment immediately. Jane is adamant about holding me to the 30-day notice in our "rental agreement".

Is this agreement even valid or legal, since subletting is not allowed in her lease with XYZ Corp (the owner)? How do I get out of this bad situation? She is also holding a one-month's deposit.

No, the sublet is not legal if you didn't know subletting was not permitted when you entered into the agreement. But just because you entered into an illegal agreement doesn't mean that you will likely see your deposit back unless you sue your roommate for it and prove the sublet is illegal to a judge. You might have to chalk this one up to experience for any future plans on subletting.

Your contract with her remains valid, but she is in breach of HER contract with the landlord. If you really want to get out of your lease with Jane, simply tell her you're going to take YOUR lease to the landlord and show it to them, unless she signs off on the lease and returns your deposit.

She is breaking the law. Try contacting your local Tenant's union for assitance. You may have to take her to small claims court to get your deposit back. Good luck!

You could threaten to go to her landlord and report her.
