In August of last year, I was traveling for my company in another state for 2 weeks, and I rented an Avis rental car. I was involved in a car accident which was determined by the police as no ones fault. I did not take out the rental insurance and did not have personal auto insurance at the time (stupid I know!). The company did not have travel insurance on the companies AMEX card. I did not report the accident to the company at the time in fear of losing my job, and now over a year later, a lawyer representing Avis is trying to sue me for $18,000 which is the full value of the car. (Also.... the accident took place while returning from dinner, but I was staying overnight)
My question is.... Should the company I was working for at the time be responsible for the damages beacause I was on company time? Don't forget, a year has gone by so i'm not sure if a staute of limitations has any role to play in this.
