I work in a office for a where there is one employee who, throughout the years has underperformed, is unreliable, frequently late and calls with mysterious excuses, and sleeps at his desk.
The problem is that our former boss has felt sorry for this man and allowed this to happen for 15 years (he is soft). He always gave him outstanding evaluations, generous raises, and talked him up big. (They shared a common bond because they were both foreign-born).
After 15 years of this, some of us went over our boss's head and took our complaint to management. To make a long story short, our boss was demoted and this man was put on probation. He is still underperforming and probably never will because he can't.
Why can't you fire someone for underperforming? Certainly, this can be proven. Do you have to give warnings? Are they afraid he'll cry racism b/c he's a foreigner? Can he sue? Why is corproate giving so many chances to this dead weight whom they know is drawing a huge salary?
