we've been renting this house since Nov.15,06.We pay rent on time every month, have never caused any issues. he house is really poorly constructed,the heat bill in the winter gets up to 400 dollars a month just being set to 65 degrees.The pipes freeze leaving us without water too.I have never complained to the landlord.We are buying a home,and I just got our closing date yesterday which is Nov. 23rd.My lease was up last June, which I guess defaults us to a month to month lease.So I got our closing date yesterday and I emailed the landlord telling him that this is our 30 day notice to move out & we will be out Dec.15 and will be paying on Dec.1st half the month's rent for Dec. We will probably be out before then, I just wanted to make it fair & give him 30 days notice.He emails me back & says that since our lease expired June 1st, that defaults us to a month to month lease and that we are required to give him 30 days notice from the 1st of the mo. leaving us to pay all of Dec. rent???

I have my final inspection coming up here next week, but my landlord keeps throwing new things at me... I got the carpets steam cleaned and look almost like they did when i moved in.. yet he wants me to pay for new carpet becuase it has some tiny stains... next the walls have a few lil scruffs in it, now he wants me to pay for the house to be repainted.. isnt that all normal wear and tear? and the worst one is he wants me get some spots in the driveway redone... $1200 to do it... so i guess a driveway can't have oil stains? and to make it worse, the drive way has cracks all over it becuase the foundation is bad... and its seems to me that if he wants the driveway back to perfect, he needs to fix the cracks.. and with that it will fix the oil stains... .. am i getting ripped off here or is he in the right? trying to charge me $2800 on top of the $1200 SD

My spouse and I currently own a home. We want to build another home on family land. Are there any programs we can use to avoid two mortgages? We cannot afford two mortgages and don't want to have to sell our home, move into a rental, then move again. Any advice is appreciated.

Let me start out by saying I live in the state of Missouri, I know laws can vary state by state. Also I'm in no way wanting to screw my landlord over, I just want to do whats fair and have him do the same.
My heat went out last night and I have called my landlord and even gone downstairs to look at the furnace myself, hit a reset button, checked the pilot light, etc.
Anyhow its supposed to get into the 30's all week at night. I'm using a space heater right now but its not really doing the job very well and its only in the 50's outside right now. I'm scared that its going to be downright freezing in here again, isnt there some sort of law that states my landlord must provide heat when it gets to a certain temperature outdoors?
I have looked at various websites and have not found any clear definitions, just wondering if someone out there knew.
Also if I call an HVAC guy myself is it in my legal rights to withhold the amount it took to fix the furnace from the rent?

My friend has a home that she is paying on a mortgage. She has got 4 months behind on her mortgage and the bank is proceeding with foreclosure. She is low income and was already struggling with her mortgage payments before the foreclosure. Is there anything that she needs to do or will the bank come after her for any fees? I don't think she will be able to afford to make anymore payments and she has kids.

Can an individual file a Deficiency Judgment on you from a Warrenty for deed?
I have been dealing with these people for quite some time. The home was not taxed in my name, loan was not in my name, the house is already sold supposedly, and they are saying they will file the judgement with all the credit bureau's plus any property that i own now or acquire in the next seven years.
I dont understand all of this. 3 months ago they needed a quit claim deed now they sold the house. if it is not one thing it is another.

I just moved into a four apartment building and I live in the bottom aparment. I discovered it is a pretty old building and it has several shortcomings. The water from the bathtub is brown for a while before it clears. The kitchen cabinets smell moldy. But the worst part is that the wooden floor of the upstairs neighbours squeeks like crazy and it is really becoming intolerable. I talked to the landlord but he claims there is nothing he can do about it. I want to move out, but I don't want to break my lease (I still have about nine months to go). My lease states that if the apartment is uninhabitable, the landlord should either fix it or terminate the lease. The lease does not say what is considered under uninhabitable, so I was wondering if the complaints mentioned above would be enough to consider the apartment uninhabitable? Or is there another option? I would really appreciate any usefull tips. Thanks!

Myself and my partner have been renting a first floor, 1 bed flat since september and all is going brilliantly apart from the fact that the flat is not double glazed and there is even a window missing from the bathroom. As you can imagine, in the cold winter nights we are absolutley frozen to the bone, even if we put the heating on it just goes straight out the window. I really dont want to move again as its really conveniant for work and close to our parents houses, also we just havnt the time to look for another place. So my question is, what obligations does my landlord have towards the upkeep of the flat? I mean, we have always paid the rent on time and we are generally good tennats. Is it her responsibility to maintain it? because at the minute it's really inhospitible, we've been forced to spend the nights at my moms house. To me that seems wrong because we pay our rent and should be able to live there comfortably? Opinions please?

We sold our house 15yrs ago to finance the purchase our sons business.We bought another house and put it in our sons name as a security for the business which is in his name but we have lived in this house for over 15 years . He has been paying the mortgage as part of repayment for this through the business account. His business is now in danger of being declared bankrupt. We are a retired couple and would like to find out what rights we have to the house and what options we have. We have no where else to live this is now our home.

If I am buying a foreclosed home for 219k of which 208k is being financed (5% down approx.) and the home comes back at being valued at 285k from my mortgage company, am I still required to pay PMI? If so, how in the future would I be able to eliminate it?

I am wondering what happens if I just stop paying my mortgage. How does the process usually go and in which time? Are there any laws or regulations? How long would it take until I have to leave the house finally. Would there be any consequences?

I see Chase apartments in Morganza, MD on this website (first listing on page 5) that say they are only $375 for a 2 bedroom, and I would like to find out if there are any 2 bedrooms available and if they are really only $375/month, and also how much it is per month for utilities:

^ The number is a local number, but for some reason whenever I call it still says "you must first dial a 1...", as if it were a long distance number, but I can't do that because I am on campus in college, and I can't make long distance calls from here. So if someone could, please call 301-475-8548 and ask if they have any 2 bedroom apartments available, if they are really only $375/month, how much it is per month for utilities, and if they require a credit check. And tell me what you found out when you answer this question. It would seriously mean so much to me if someone could please do this, and I will give the first person 10 points. Thank you.

We received our first mortgage payment yesterday and it is higher than expected. The entire time we were working with the mortgage consultant or whatever her title is, she was telling us something different. She emailed me several "good faith" estimates. Even as we were signing the loan docs I called her and she reassured me everything was fine, the payments were what we thought. We are flipping out right now. Can a mortgage company lie to us and do this legally?
