Attention Finance Wizards!

It's taken me three and a half years but I've managed to pay off my credit card debt! I did this by lowering my pre tax contributions to my 401k (which the company is matching) and putting as much as I could into paying off this debt.

Now that the credit card debt is gone, II'm at a cross roads. I don't have a safety cushion for if I lose my job, and ideally I'd like 3 months worth of my salary in savings.

My question is: Do I build the nest egg first (3 months worth will take me 5 or 6 months) -or- do I put as much as I can into the 401k and build the nest egg slowly?

I made a simple mistake when I was 4 years younger. This mistake has a simple assault conviction on my background. I cant get a job or a place to live. Im living with my mom and her husband along with my 8yr old son. What do I do. Does anyone know any good attorneys in TN that can help me get this off of my record. Does anyone know where I maybe can work? Ive been denied several jobs and Ive lost a few because of this. It seems as if it actually did not start showing up until 2005. What do I do? Im really not a bad person I deserve to live my life and take care of my son without begging for work or shelter. I dont want handouts I want to support myself and my son like the average American.

My company pays me $2.68 per hr the rest is in tips. They submit the $2.68 plus any tips paid by credit card or debit. Any cash tips are up to me to submit to the IRS. I average about $15.00 per hr.

What if the same person upon getting fired got the balance of their salary upon termination? (they got $10,000 in salary up until May, then got fired and got the additional $14,000 in one lump sum payment).
Are they still able to collect unemployment if they got all of their salary for the year?

Reason Why Ilm asking is because, Dental Employers will see my resume and talk to me on the phone and when they meet me and see that I am African American AKA Black they either have me sitting in the lobby for 30 minutes and tell me to come back another time, or interview me and tell me they'll call me and never call what should I do. I'm always neatly dressed, very professional, Is it really this hard to get a job in LA when your black?
