Consider:
There is a promise of performance.
There is a quid pro quo, the votes for the performance.
If there is a failure in the performance, shouldn't there
be recourse?

It would certainly make an interesting class action suit.
It would be an interesting and very democratic
additional 'check and balance`.

With the Elections coming up, any thoughts?

I am an atheist. I do not believe that there is a (big G) God or a (little g) god or a goddess or a flying spaghetti monster for that matter. Yet I live in a country that has adopted "In God WE trust" as MY national motto.

The first amendment to the Constitution - the primary specific right granted in the bill of rights - promises me that my Congress shall pass no law establishing a national religion, yet they violated this promise to make the idea that all Americans trust in one and the same God the central thematic idea of our shared rallying cry.

The truth is, however, I do not trust in God. Neither do the Hindus who live here or the neo-pagans, or the Buddhists or Seiks or Shintus or native Americans who practice the old religions. So can you acknowledge that the national motto should never have been made "In God We trust?"

Just wondering.

If the definition of a terrorist attack is one that directly targets civilian non-combatants then why does the west have such double standards? For example, my lai massacre, northern ireland events, hiroshima, nagasaki, tokyo, dresden, london, rotterdam, king david hotel, etc, etc, etc.

Someone please explain to me how those are acts of war to be proud of but when a muslim does it to a westerner it is "Terrorism"?

The usual answer I get is, "Well we were nations at war, and they are guerilla organizations." If you feel that way, then please tell me how you can honestly believe it is OK for a nation to target and kill civilian non-combatants but it is NOT OK for an organization to do so.

The largest dam in Iraq is in serious danger of an imminent collapse that could unleash a trillion-gallon wave of water, possibly killing thousands of people and flooding two of the largest cities in the country. Mosul would be buried under up to 65 feet of water and parts of Baghdad under 15 feet.

Why do they flock to see a fictional movie, like Farenheit 9/11, made by a traitor, Michael Moore, but refuse to see a true documentary, like Obsession? Here is a trailor of this factual movie. Do the Libs think Conservatives paid these Islamic terrorists to pose, and act for this movie? They might think it's an "inside job".

4. Two adults, John and Jackie, were eating lunch together when John says; “I really need to sell my Harley Davidson motorcycle for $6,000 so I can pay my bills.” Jackie says, “I love mopeds, I will pay you $6,000 for your scooter.” John replies, “Great, I will deliver it on Monday.” Jackie is very upset when she sees the motorcycle on Monday.

a. Was a valid contract formed after Jackie’s response that she would give $6,000 for the scooter i.e. before John’s final response? Why or why not?

b. Was a valid contract formed by the end of the conversation i.e. after John’s final response? If so, is it a unilateral or bilateral contract?

c. Identify and explain any possible ways Jackie could get out of the contract if a valid contract has been formed. In your opinion, would Jackie be successful in rescinding the contract i.e. is it likely a court would declare it void? Why or why not?

d. Is this situation covered by the UCC or common law? Explain.

Boeing's profits increased 61 %. Lockweed Martin, 22%. Northrop Grumman 62%. The Pentagon now uses up half of the discretionary budget, and Arms Manufacturers are making a killing!

"As Columbia professor Richard K. Betts points out in Foreign Affairs magazine: "With rare exceptions, the war against terrorists cannot be fought with army tank battalions, air force wings, or naval fleets—the large conventional forces that drive the defense budget. The main challenge is not killing the terrorists but finding them, and the capabilities most applicable to this task are intelligence and special operations forces. ... It does not require half a trillion dollars worth of conventional and nuclear forces."

Are we spending money unnecessarily, waging war with weapons that could be described as "overkill"? Should more funding be put into Intelligence Forces? Are we simply providing hefty profits for weapons manufacturers who are enjoying a bonanza of profit?

2. Figure damages for the car loan refinance contract I handed out in class given the following circumstances. Assume that the borrower defaulted on the loan and did not make any payments after the first six months of the loan. The car was repossessed by the Bank and sold for $8,000. The principle amount due on the loan at the time of default was $10,000 and the interest due including penalties totaled $2,000. The Bank spent $1,000 on legal fees and $500 in court costs. In addition, it was foreseeable by the parties that the Bank would have to make some basic repairs to the car and would have to have the car professionally cleaned prior to the sale, which cost $1,000.
