Renting & Real Estate - December 2007

I rented for 7 yrs. my landlords handyman bought the place abut 4-5 yrs ago. I signed a new rental agreement that i never got a copy of. This yr my landlord moved in up front after forcing the other tenants out who lived there for 15 yrs. My landlady was very nosy and they made life miserable for me. Fortunately a friend had a nice place that would be rentable in 6mo to a yr. They did some bad things to me while I was there waiting to move. But I kept my cool. When it came time to move I gave my 30 day noticed, cleaned the place and asked for a walk through a week before my last day there. After the walk through she would not tell what she wanted fixed. She sent me a list on my my last rented day when I handed the keys over. I got 1/4 of the security deposit back 27 day later in the the mail with a list of repairs. i plan to take her to small claims court. Do i have a chance. I have documented everything that ahppened to me and taken pictures.

I've had a lot of health problems that have completely messed up my finances so I need to move to a cheaper place. I still have 6 months left on my lease, though. How can I get out of my lease without being evicted?

Long story short, I live in Los Angeles. I presented my 30 day notice but I moved out fast leaving my place empty for 15 days. The management company called me to see if they could have the painters come in and do some work but I said only if I got half of my rent back and if we ended the lease. They were going to check with their managers but never got back to me.

Last night my girlfriend send me some pictures of some work that has been done on the apartment without my consent. My girlfriend also mentioned that they left the door unlocked. Is my landlord trespassing? What are my options here?

I know that when they do a credit check they will see previous addresses. But do I have to tell them that I rented before. Its not that I owe the landlord or anything, but there was an confrontion with me and my boyfriend there and its in our record and the last apartment community turned us down because of that. I just wondered could I just make it seem like I am a first time renter or could they investigate those previous addressess.

Do you think they are as good a finding a used home for sale? You can choose pretty much anything you want, color, style, extras etc. and it is brand new for the same cost as a used home. I am stuck on deciding what I should do... have a house of my choice built and delivered (of course I would have to buy land), or search around for a house thats been lived in and I have to make any repairs to... what do you think?

want to vacate due to the fact that we can no longer afford the rent here. We paid a deposit before we moved in, which equals the same amout as a months rent. (however it was called a "deposit", not "last month's rent") We found where Wisconsin law says that we can give written notice of 21 days, but can we legally use our deposit as last months rent?

i live with someone who has purchased a house through a state title agency for the last 3 years 3months. i sold my house in illinois to move out to arizona with him, we were involved in a relationship at the time, we both renovated both places together, mainly using money charged to a credit card in my name. myself and my mother have been paying 2/3's of the payment for that entire time and i would like to know if there is any legal action i can take as to a share of said property? there are 2 dwellings on the property. my mother lives in one and the gentleman and myself live in the other. we are not married and i have written a check for the payment, in my name only, for every payment. also, he does not claim rent on any taxes for these "rent payments" in which he claims them to be. do i have any legal rights to a share of the property? yes i know i should have had my name put on the title.

We've been trying to refinance our home for the past 2 months. The mortgage co hired an appraiser and all paperwork was completed. Now we find out that the underwriter does not approve the loan based on the appraisal. Why and how often does this happen? Why would the mortgage company hire an appraiser to perform an appraisal, that ultimately the underwriter would not approve?

So I gave my 30 days on the 1st of December thinking that I would have found a place to live by the end of the month. Well I haven't found a place yet. A landlord at a place I'm looking to rent said that as long as I inform my current residence that I can't move I can stay here, but my current landlord isn't very happy right now. Can I legally stay here and pay a prorated lease. State of California btw.

Thanks.

I am a member of a State Employee Credit Union. They offer a first time home buyer loan that is a 2 year ARM. It's a 100% loan with no origination fee and no PMI. It can reset up to 1% every 2 years. I am looking at a townhouse that is about $130K. I plan to stay in it between 4-8 years. Does this sound like a good loan? How hard would it be to refinance after 4 years?

I am hoping to make an offer on a house within the next couple of days. It's a FSBO, so no realtors are involved which helps as far as there being no real estate commissions on either side to be paid. Asking price is $258,000 and I would like to start by offering 20% lower at $206,400. The property has been on the market for at least 9 months, however I don't know that the seller's are anxious to sell and may not mind holding the property. The market in the area the home is located is very slow right now and on the border line of becoming a distressed market. I really don't think they've received any other offers on the property and doubt they will any time soon. Is offering 20% lower than asking price reasonable with today's market conditions?

The paint in my bedroom began chipping. My apartment has ladybugs this time of year and all the ladybugs in my bedroom are dying. The ones in the living room are alive and well! Is there anything to think of this? Ive brought it up to my property manager and she pointed out a clause in the lease that says even if my apt tests positive for lead paint there is little I can do and it is not terms to break the lease. Is this legal? How can a person be forced to live in a place under circumstances that are harmful to their health?

I was not informed of the possibility of a sale until 12/5/07 and then only by email, which gave me only three-business days notice I did not know what to do, To make it worse she left the office early that Friday at 1:30 and they could not be reached over the weekend per their email. Every phone call I made from 12/5/07 on was delayed by the office telling me to hold on as they “must contact the lender and get back to me” they even stopped returning my calls on the day of the sale. While on the phone waiting to hear from the lender; he is auctioning off my home. Currently 150k in equity I was only behind 9k. I believe they did this to lead me on until the sale was over.
I was told there were no other bidders and my lender bought my house for himself. Now my lender wants to rent my house
help.I was delinquent on my second mortgage and I do not dispute any fault on my part for being in this position I was lied to by the lender. Help
