Does a lease, on residential or commecial property, survive a foreclosure, or is terminated by a foreclosure? What are the rights of a tenant after a foreclosure? I'm in Massachusetts if that helps anyone who knows.

Ok so my dad asked his friend to co sign for a duplex house and now he wont sign off of the loan we offered to pay him off first $1,000 then $5,000 he doesnt want to sign... His name is not on the deed actually he signed a paper signing out of the dead however his name appears on the loan so if we wanted to sale or refinance like we are trying to do we wont be able to without his signature! he says that if we stop paying the mortgage he doesnt care if it ruin his credit.. he wants the bank to repo the houses but he has never lived there so the ones that are being hurt are us.. see we have lived in that house for 20yrs and owned it for 3 anywhere that we turn to seems that no one wants to help everyone says there is nothing we can do.. But we dont loose hope there has to be something we can do?? What can we do in this case?? Is there a way to do something without him, hes never paid a dime towards the houses all he did was sign.. Please HELP!!

It's appraised for 146,000.00. 2 bed rooms, 1 bath, and a beautiful backyard. I live in St. Petersburg Florida. I would like to see as soon as I can. I would like to sell for at least the appraisal price (only makes since to me, why sell a house less than what it's worth).

On my lease, the only thing it states is that he (or an attorney) can enter and hold the premises if we don't pay rent; it doesn't say anything about reporting me to a credit agency. He's calling now and threatening me by saying he's going to report me and my roommates to a credit agency. Can he?

my landlord wont let me break my lease unless i pay 2 months rent. she wouldnt give me a good reference until i wrote on a piece of paper, i _____ _______ am putting in my 30 day notice and agree to pay blah blah. well she already gave me my good reference so what will happen if i dont pay the money. will that piece of paper hold up in court? do you think she'll even take me to court? what happens if she does take me to court? i really cant afford to pay this what should i do?

how do i know what to rent it out for? also my mortgage went up because i thought we'd move out by 2 years so now that we're a little behind i decided not to refi since i thought we'd be selling. however its a tough market so we may have to rent it out. should i refi to get the mortgage payments lower before i rent it since the mortgage is definitely high for our home. i need advice and ideas of how to maybe rent but make a little money too. anyone rent out there and how do you work it and figure out what to make the rent amount?

I'm selling real estate in Florida, and I'm currently in contract with a buyer. A large deposit is in escrow, but it is contingent on buyer's ability to get approval for a loan. He is approved for an 80% loan, and would have to pay 20% down at closing. This sounds like a usual type of loan given this housing market, even though the buyer wants a better loan. If the buyer does not go through with the contract, and claims he was not able to get the loan he wanted, am I eligible to collect the deposit that is in escrow?

Can the owners start to make them get a survey done, an appraisal done, and a home inspection done this soon? I thought they would have a year to decide if they wanted to purchase the home. The owner states that her son really needs to get the house sold now because he needs the money. Our daughter doesn't want to be continually told to have to get this done now or get that done now, but wants to make sure that the home and area is where they want to be for a long time. Our daughter is a very easy going and kind person and wants to make sure that she keeps a good relationship with the owner. How can she handle this? She lives in Houston Texas. Thanks!

My roommate and I didn't provide enough notice to end our lease at our apartment complex and now we're roped into another year on the lease! The problem is we both are moving for jobs and school, so now we need to sublease. I put an ad in the paper, online, and put up flyers! What more can I do to get someone to sublease my apartment?!?!

My neighbor's landlord knocked down my fence 2 years ago and is now refusing to pay half for a new fence. I called the county and they said there is nothing I could do, but I think it is considered a public nuisance since it is visible from the street and is a safety hazard to my family. Also, the landlord, who rents the house, is not giving me or her tenants any privacy. The landlord owns a 1.2 million house and is still refusing to pay.

Hi guys,

I have a question for all the expert legal minds out there. My parents are separated, and want to figure out an amicable arrangement for division of assets. As part of the the agreement, my dad has suggested we split the ownership of the house between him and me, 20%/80%. He has agreed to continue paying the mortgage on it until it is sold.

Is this type of agreement legally enforceable, and is there a way I can legally enforce it? Would I be entitled to 80% of the value upon sale of the house, or 80% of income generated from the house? Because he is still the holder of the mortgage on the house, I'm not sure how valid my 80% claim would be.

Any help would be appreciated greatly. Thank you!

I moved into an apartment with a friend 3 months ago. The lease is solely in my name. It is a one year lease from 5/27/07 to 5/26/08. Unfortunately my roommate got fired and I can't find another one to take her place. I can't afford the place by myself, so I need to move. Is there anyway for me to get out of my lease with out going to court or paying the other 8-9 months of rent in advance?? I read through all of my lease papers and did not see anything about what happens if I need to cancel my lease, it also said I cannot sublet so me renting it to someone else isnt not a good solution. Ugh. I live in Los Angeles County if that makes any difference. Thanks for all the help!!

Hi. We bought our house in 99 for $145 k. We then refinanced and took out a loan in 03 - so our new loan balance was $210k. Our current balance on the house is about $198k. We're still paying a hundred and something dollars for PMI. I'm not so great at this stuff and I read that you'd have to meet a 20% loan to value on your loan to be able to get rid of PMI. We checked the value of our home just online, and it is a supposed $522k, i doubt that is accurate. The two homes right beside us have sold in the last couple of years for over $400k for sure.

I would really love to stop paying PMI but I'm wondering if we are even eligible. I could call and ask, but before I do, I'd love to know if we are even close to that 20% LTV. Wells Fargo won't just tell you, they have to have an appraisal done by them for $150 whether or not the result is PMI removal or not.

I live in Queens, NY and want to know what my rights as a tenant are. We have lived in the apartment for over 24 years and do not have a lease, we pay month to month. We have never had any problems and have always been great tenants. We are being asked to leave so the landlords grandson can move in to the apartment. She mailed us a note giving us until November to move out. That is too short a notice in my opinion after having lived there for so long.

I've decided not to renew the lease and I am going to move elsewhere for better location and quality. I asked the manager if I could give her a notice to leave the apartment that is more than 30 days away. I explained that I didnt want to give the standard 30 day notice because I didnt know if I'd have someting lined up by then. She said all she can give me is the 30 days before I have to leave the apartment. Is this LEGALLY all she has to give me??? I've been on a search for a new place, but most have waiting lists that are too far away. There is one application for a new apartment somewhere being processed right now and it may come back approved in a few days, but I'm not sure. How can I buy more time at my current apartment. Is she right about the 30 day thing???

Home in foreclosure.Filed chapter 7 to walk away. But thinking of switching to chapter 13 to keep home longer to get a sale. Any suggestions? Anyone familiar with this process. Also, it's hard to even find rental b/c of credit rating at this time, thought about selling to investor to rent back. Is that a good decision?

I recently lost my rent money order without it being filled out. Not even the stub was kept because I just got it and being stressed out I don't know what happened to it. Im freaking out because we are late with the rent now, and I have been looking for it like a freak all weekend. Any action I can take. I purchased it at a cash checking place.
