The system shoots a beam of energy that makes people feel they are about to catch fire. It neither kills nor maims, but the Pentagon has refused to deploy it out of concern that the weapon itself might be seen as a torture device.
How I see it is, that with intent torture, the person who is being tortured is detained and held against his will so they can not leave. WIth the ray gun its deployed in an open area and anyone in the area not wanting to be exposed can leave the area, Unlike torture where they are held captive.
