I was living in an apartment in Oklahoma city recently with my boyfriend until he got deployed to South America. We had a month left to go on our lease but we didn't feel like trying to get out of paying for it so we paid that month's rent and moved out at the beginning of the month and gave proper notice. Since we didn't have much time to get out of the apartment (I was going to live with family until he got back) we left it kind of messy. Now they are trying to make us pay over $1100 for carpet replacement and for garbage disposal. My boyfriend says that he will be able to get a loan for the money but not until he gets back to the states in January. Since we are not married, they are trying to pin all of this on me. Is there any way that we can postpone paying this money legally until he gets back.

I am so upset. I need some help. Here it goes. I bought my first house on 6/28/07 for $331,000.00. Within 5 months the houses in the new area have drop almost $100,000.00. I am so mad. Is there anything that I can do? In our area on the news, my Mom has heard of a class action suit against a builder for this exact reason. Does anyone know or heard of this? Please help, I feel robbed.

My ex-boyfriend and I are having terrible problems. Recently, I found out I am pregnant and need to move home to get proper care. He refuses to be civil and let me back out of the lease. I made a call previously to authorities when he tried to kick me out so there is a record of previous violence. I am wondering if I can use this to get out of the lease and leave him liable? He is capable of affording the apartment (I am not). He also said he wanted me out before.

HOW do I get out of this without breaking the lease or ruining my credit?! I can't live with him I'm afraid of losing this baby!

My husband is military, we started to rent a place in Arizona, we now have to get out of the lease because he is going to go remote, which means he will be all over the state as the task force needs him. So he will not be able to keeo the rental. My husband had them put in the lease a military clause, but we are unable to produce any papers stating that he is going remote. They are verbal orders. I showed the landlord the line on his orders which states he can be moved anywhere in Arizona per task force needs, but he is saying that he needs something different from the original orders. Something that would state that he is unable to stay in the house because of a change. But my husbands base will not make new orders for something already stated. Please see the military clause I am attaching and tell me, is he right, or are we right, or what can we do? Please Help!

Any other provision of this lease to the contrary notwithstanding, at least thirty (30) days prior to the normal expiration of the term of this Lease as noted under the heading TERM OF LEASE above, Tenant shall give written notice to Landlord of Tenant’s intention to surrender the residence at the expiration of the Lease term. If said written notice is not timely given, the Tenant shall become a month-to-month tenant as defined by applicable Arizona law, and all provisions of this Lease will remain in full force and effect, unless this Lease is extended or renewed for a specific term by written agreement of Landlord and Tenant.

If Tenant becomes a month-to-month tenant in the manner described above, Tenant must give a thirty (30) day written notice to the Landlord of Tenant’s intention to surrender the residence. At any time during a month-to-month tenancy Landlord may terminate the month-to-month Lease by serving Tenant with a written notice of termination, or by any other means allowed by applicable Arizona law. Upon termination, Tenant shall vacate the premises and deliver same unto Landlord on or before the expiration of the period of notice.

Military Clause: This Lease is executed with the express understanding by Landlord that Tenant is on active duty with United States Armed Forces. Therefore, the lease may be terminated by Tenant (1) 14 days after Tenant notifies Landlord, in writing, that the Tenant has received involuntary permanent change of station orders to a duty station located more than 50 miles from Phoenix, Arizona. (2) 72 hours after Tenant notifies Landlord, in writing, that the Tenant has been activated for Title 10 orders overseas (3) 14 days after Tenant notifies Landlord, in writing, that Operation Jump Start ends before June 30, 2008. Tenant will provide Landlord with a copy of such documents as may be necessary to substantiate the exercise of this military release clause. When this Lease is terminated through this military clause, the deposit will be returned to the Tenant minus $300 non-refundable cleaning fee and other fees for damages to the property, if any.

We bought our house a few months ago. When we started to use the oil furnance last month, there was always the smell of old mechnical oil in the air. A service guy told us that the furnance could no longer be used for it had a crack inside and was releasing exhaust gas. We were wondering if the previous owner should also take some responsibility to sell the house with a furnance functioning dangerously? Please advice. Thanks!

I recently bought about 8 acres and to get to my 8 acres I must go through a gate that passes through someone elses land. The other person has 20 acres and to the south side of their land is a road that stretches the entire length from the front gate to my gate. On my warranty deed, there is no mention of this road being or having an easment. Instead there is a grandfather clause on that road and people with land behind mine use the road too. It passes through my land as well. My question is, if I wanted to get a mortgage loan to build a house, what type of easement will I have to get in order for the loan company to lend it to me. I've been told that there needs to be an easement in order to borrow money. Where can I get this easement from and do I have to involve the people infront of me in any way? Also, if I wanted to put an automatic gate in the very first entrance where the road begins, who do I have to talk to. Im willing to pay for it, can I just put it up?

HELP! We bought our first house this summer. It is on a cul-de-sac. The driveway leading is quite narrow, only room for one car and short, so you can't park two cars end-to-end without blocking the sidewalk. We began to park our second car to the right of our driveway, in the grass, planning to pave or put down gravel later. Our neighbors placed a rock in the path soon after. We went to them to ask if parking there was a problem. They said that the property line dissected the path we were pulling through to park, so if we would just pull around the rock, they'd be happy. We have done so since then. Now they have pulled a flatbed trailer in the grass where we have parked. They have a large two car garage and a wide driveway. We plan to have a survey done as soon as possible, but I'd love any suggestions on this. If we park on the street, we will always end up blocking someone's mailbox, resulting in no mail delivery. HELP!!! :)

My apartment got flooded by the lady upstairs plumbing leaking into my apartment. My carpet got damage and my clothes got soaked. My renters insurance only provided coverage if my thinks get destroyed by a storm so I got no compensation. I contacted the housing inspector and she gave the apartment manager to dec 6 to get the repairs done and they have every excuse in the book such as we dont have the supplies yet to fix the drywall and change the carpet. Now my master bedroom has mold on the walls , ceiling and closet and my lease doesnt end until May of next year. Should I brake the least and ruin my rental history or try to wait for the repairs or housing inspector to take action? What would you do ? Any legal advise, sugesstions or experinece

If I look at foreclosures on the yahoo website home listings and I find one for say $1,400. Is that what it actually costs? Or is it what is owed at signing and its really going to be way more expensive. I am not sure how foreclosures work, nobody has ever really explained it to me. All I know is that the properties are where banks have repossed them. Please help me out. Thankyou

I have my home for sale and I accepted an offer to purchase. However, on the offer to purchase there was not a closing date in the offer. Now the people who made the offer are trying to tell me that the offer is null and void b/c there wasn't a date specified. Is this true? The main reason I didn't care about the date was b/c in my counter offer I put a "bump clause" meaning that if another offer came in that I would have to give the first person who put the offer in the chance to remove contingencies or they would be bumped to secondary offer. I'm just wondering if it's true the that offer is no good.

Hey all,
I started my refi back at the end of Sept. however, there were many things that we needed to get together. My taxes were due Nov 15th. The loan guy says not to worry..that everything is ok because they will allow me 6 months before they get ready to take my home! lOL...So my question is..who pays for this?....i mean, does it come out of my equity? He says we should be closed by the second week in december. So this will mean my taxes will be a month late. HELP!
