Immigration - December 2006

Hi all,

Happy Holidays!

I have a GC and a reentry permit. My reentry permit expires on Feb 2008.

I left the US on Sept 2006, going back to the Philippines to finish my bachelor's degree. I need a total of 3-4 years to get my degree.
But my Reentry Permit only has 1 year and 5 months left, before it expires.

I am planning to return to the US on Dec 2007 to apply for another reentry.
By then I would have been out of the US for 15 months with a reentry permit.

My question is:
*Can I leave the US right after I apply for a second reentry permit?
without having to wait for approval ?

*Also the fact that I've been away 15 months with the first reentry permit, will it endanger my GC if I leave the US right after I send my second application?

*As a basically jobless student, do I need to file tax for the US?

I have a credit card that my father(also a GC holder) gave me, Public Library Card, DMV I.D., SS Card to show that I have no intention of abandoning GC status

President Bush is pursuing a globalist agenda to create a North American Union, effectively erasing our borders with both Mexico and Canada. This was the hidden agenda behind the Bush administration's true open borders policy.

Secretly, the Bush administration is pursuing a policy to expand NAFTA politically, setting the stage for a North American Union designed to encompass the U.S., Canada, and Mexico. What the Bush administration truly wants is the free, unimpeded movement of people across open borders with Mexico and Canada.

Georgia's new immigration law requires anyone applying for state aid to first be verified that they are in the state legally and employers [with state contracts] are being held accountable as well, sanctioning those who do not verify immigration status before employing someone.
According to the National Conference of State Legislatures, Georgia's new immigration law is the first to make it through a state legislative session this year. Many of Georgia's immigration statues will not take affect until 2007, giving state agencies time to adjust and prepare. Georgia's new immigration law will not affect emergency medical care and educational benefits for those in kindergarten through 12th grade, which federal courts have said must be provided regardless of immigration status."It's a punitive bill," said Sara Gonzalez, president and chief executive of the Georgia Hispanic Chamber of Commerce. "This is a very complicated issue, and I don't see any good coming out of this."

California recently reported that it costs $9000+ per year to educate the average child. There are about 30 million people living in California. There are approximately 1.5 million students. Since CA does not count students by legal vs. status we do not know the cost of financing legal nor illegal students. In CA 37% of the income tax filers pay more than $300 in state income tax. It takes about 30 filers to pay for just one student. CA has expressed interest in reducing class size overall to 20 students, but educators say we can't because we must use that money for the illegal students. What would be the consequences of passing legislation allowing only 20 students inside a classroom?
That is, using the money for U.S. citizens and legal residents or students here on visas? Could we offer busing to other school districts for illegal students? Could we offer school in tents for them? If legislators forced the issue and allocated "seperate but unequal" to illegal children..what'd?

Kris W. Korbach on
State and Local Authority to
Enforce Immigration Law
June 2004

State Arrest Authority

The preliminary question is whether the states have inherent power (subject to federal preemption) to make arrests for violation of federal law. That is, may state police, exercising state law authority only, make arrests for violations of federal law, or do they have power to make such arrests only insofar as they are exercising delegated federal executive power? The answer to this question is plainly the former.

Background
The source of this authority flows from the states' status as sovereign entities. They are sovereign governments possessing all residual powers not abridged or superceded by the U.S. Constitution. The source of the state governments' power is entirely independent of the U.S. Constitution. See Sturges v. Crowninshield, 17 U.S. (4 Wheat.) 122, 193 (1819). People who are pro-immigrant should be very, very happy that presently we accept more than 1,000,000 people annually as Legal Permanent Residents. We also accept relatives of U.S. Citizens wihout limits. We accept over 100,000 HB1 workers each year. What I have difficulty understanding is why anyone believes we should add more than that number (the highest in any country in the world) to our already very crowded country? Do you agree or disagree?

Schools, banks, welfare agenices, hospitals, clinics, police, housing agencies, telephone companies, and security guards protecting government buildings are often forbidden to ask a person his or her legal status in the United States. These agenices are prohibited from keeping or reporting statstics on client legal status. Should they be required to keep data and publish it on the web?

Permission to stay away in other country is restricted to one year only, beyond which the greencard holder is required to apply for an extension of two years. The application has to be filed while in usa.
However an usa citizen have issued threats and so it wont be safe to travel to usa,and apply for the extension. This will cause the greencard to get lapsed which will be damaging..
How to get the extension to stay away from USA for more than a year and still keep the green card active?will the threat from an usa citizen could be an excuse for applying for the extension while in foreign country?

I was told that I can "invite" (I think the correct term is "sponsor") someone to come to the U.S. on a "visitor's visa," and that that sponsorship is the quickest way someone can get a visa. Which visa should the person apply for? I want to read up on it.

A respondent to one of my questions made the assertion that illegal immigration drives down pay & ruins schools & burdens social services. How could this be when NYC, a great sanctuary city, is in it's greatest period of prosperity & has is once again America's safest big city according to the FBI? (And SF isn't far behind!)

America's santuary cities seem to be some of it's richest--not only in terms of diversity & culture, (NYC, SF, Boston, Miami etc.) but also regional economic powerhouses. Do you believe there is any correlation between these city's social policies & their greatness?
