We have been accessing our private forecourt for over 26 years by crossing over the pavement outside the business. Local Authority has now increased kerb hight prevent either us or our elderley and disabled customers from accessing our forecourt. It falls a few inches short of the "legal" size to demand a cross over - any one out there who can advise.

The Chungs have prevailed over the judge suing them for $54 Million dollars . The judge gets ZERO and the Chungs get 'Costs' .
Does that mean they only get 'court costs' ?

Can they sue him in civil court for their losses on defense ?.. . . . ..btw it cost them tens of thousands .

And also very important . . . . Will the bar address the competency of the judge who sued them ?

I own some land on which I have a shop there is a drive way which comes with the land which I have been using for over 15 years to enter my property. New owners (home developers) have brought the adjacent land and have stated that they own this drive way (on the land register it comes under their property) and will build on it. We have not registered the land but are the only one who can access the drive way as we lock and open the gates. It was from our understanding when we brought the property that the drive way came with our land.

What are my rights?

Children's charities have reacted with anger after a window cleaner who raped a 10-year-old girl was jailed for two years.
Keith Fenn, 24, will be free in four months after a judge said the girl had appeared older than her actual age.

The charity Kidscape accused Judge Julian Hall of "trying to find excuses" and said a child must never be blamed.

Attorney General Lord Goldsmith is to decide whether the sentence should be appealed as 'unduly lenient'.

Judge Hall had said that the sentencing had been the most difficult decision he had ever made, but the girl had appeared to be 16.

She was attacked by Fenn and an accomplice in a park in Henley-on-Thames, South Oxfordshire on 14 October last year.

Moral dilemma

Oxford Crown Court heard that Fenn removed her clothes and raped her, while an accomplice, Darren Wright, 34, took her home and sexually assaulted her.

The judge said in sentencing he faced a moral dilemma as the fact they had sex within 45 minutes of meeting was an absolute crime.

But he said the girl had dressed provocatively and looked like she was 16.

He gave Fenn concurrent two-year and 18-month sentences, but he will be free in eight weeks after serving eight months in prison awaiting sentence.

Wright is already free as Judge Hall had already given him a nine-month sentence for inciting the girl to perform a sex act.

'Back to the 1950s'

Dr Michele Elliott, director of Kidscape said the decision had left her "lost for words".

She said: "It takes us back to the 1950s when the victim was blamed if they were dressed provocatively.

"No one in my opinion could mistake a 10-year-old child, even dressed up, for a 16-year-old. They are just trying very hard to find excuses.

"You can never blame a child victim for sexual abuse when excusing the abuser of any kind of abuse."

The NSPCC added: "There is no excuse for having sex with a 10-year-old, no matter how she dresses."

A spokesman for Lord Goldsmith said he had asked the Crown Prosecution Service to send him the papers on the case, and would consider whether or not to refer the sentence to the Court of Appeal as "unduly lenient".

He has 28 days to make a decision.

What is a reduced charge for Criminal Possession of a Forged Instrument 3rd Degree. I printed a free car wash coupon online and when I went to use it I got my car wash, after I was done the manager came out and I was told that the coupon was a fake, and instead of the place where I used it letting me pay them ($33.00) The guy called the cops and they arrested me for it. It was very stupid. I am wondering what a reduced charge for the crime would be so I could present it to the courts. I wasn't in possession of the coupon when the Trooper arrested me. I had already given it to the clerk, and got my car wash. Very Petty!!!

I had never heard of this think tank before,and now that I have some knowledge of it, it seems to me that the Iraq war was planned WAY before 9/11, in fact, it was being planned while CLinton was in office. Does the Bush admin really expect us to believe that the war in Iraq wasn't already an inevitability? Do they really expect us to believe they went in on bad intel, when ALL ALONG they had been planning a pre emptive strike? What am I missing here? Has anyone read this?

When I was younger I remember seeing on TV that there was a state you could file for a marriage in such a way that you could not file for divorce legally without proving either Physical abuse, sexual abuse or adultery.

The state of Virginia awarded a judgment to my old landlord in the amount of almost 2K dollars. I had not resided in this location for almost 4 years, landlord was initially suing my brother, who stayed there for 4 extra years after me, but decided to put my name on the file as well. Landlord had papers served at the address in which I had not resided at and after some contact he is in agreance to remove my name from the judgment. However, after my lawyer attempted to remove my name from this judgment via paperwork, the clerk of court at the courthouse will not motion to re-hear my case, even though i was never served proper papers, nor will they remove my name from the judgment even though the plantiff is willing to remove my name. The judgement was awarded in 2005 and just found out about it within the last 8 months and have been fighting it ever since. Unconstitutional in VA.

July 1st no smoking in public places. prisoners however can smoke in jail (one asks where they get the money to afford to smoke in the first place?) and prisoners can demand smoking or non smoking cells! What do you think about this state of affairs we tax payers pay for?I am livid!

I was reading on CNN.com that the woman's former boyfriend will be charged with TWO counts of murder. One, the pregnant woman, and two the unborn fetus.
Now my question is, when does the law dictate that a fetus is a "person" and can be murdered? Is it during the 2nd or 3rd trimester? Or not until the fetus has been born is it a baby and person?

And I dont want pro-lifers posting "it's from the moment of conception". I want to know that the LAW says.

I was surprised when I heard this. Resulting in the double homicide in Ohio. That this needs to be looked at as the worst threat to pregnant women.

Why do men kill their pregnant women? Is it an attack on the child or the mother? Is it associated to the man not wanting to pay child support? Or does a hate consume them?
