I have an opportunity to purchase a piece of property that is landlocked by Indian Reservation land. The tribe does not want to allow access to the land. Is there any legal recourse? Please help if you can. Thank you.

The noise level where we live has become unbearable due to neighbors. Dealt with the leasing office, called the cops, (even have a case number) confronted the neighbors ourselves and the situation doesn't get better. We can't continue to go on in this manner and it's turning ugly.
There is a clause in the lease that states we would owe some money if we vacate early. How can we break this lease without paying the fee that comes with this since we feel it's the complex itself we can no longer tolerate? If it helps..we only have less than 4 mos left and they're renovating all apts when vacated...which would include ours so it would have to stay vacant for a while anyway.
Anyone have knowledge on this?

The old owner sold without completing the repairs they said they would fix. They left mold, uncompleted electical plugs, rodents, and no heat.

When we asked about installing a heater their response was put aother blanket on, use portable heaters (circa 1949 wiring) or leave the stove on with the door cracked open.

They raised my rent $200 in thirty days and did not fix anything and on one occassion the property manager sexually propsitioned me by grabbing my elbow pulling me to him and said in a low tone, Maybe we can work something out for the rent?"

i got a memo today that says: on monday we'll be making an ispection of all the apartments. the financial institution will be checking the general conditions of the buildings and verifying occupancy of the units. And it says i need not to be present.... they checked the apartments for "drugs and pets" a couple of months ago. i dont want a stranger looking through my stuff!

I had a one year rental contract on my place which, upon expiry, converted to a month to month contract. It says that I have to give 30 days notice to leave the place. I gave that notice on November 26th, for a departure date of January 16th - way more than 30 days.

My landlord is saying, though, that I have to pay rent through to the end of January, that I can't just pay to January 16th. The contract mentions nothing explicity in that sense.

Anybody know legally where I stand on this?

We found a FORECLOSURE property in which we're interested. I've read that the seller pays the full 6% commission to the seller's agent & that the seller's agent then splits the commission with the buyer's agent. When we bought our current house, we had to negotiate for the seller to pay it. Perhaps that was because it was a FSBO? If you go it alon without a buyer's agent is it ever possible to get that 3% attributable to the buyer's agent as a "discount" on the home price?

I don't mean to sound callous, but if we did go with a buyer's agent, it doesn't seem fair that they would get a full 3% when we did the work to find the house. Plus, my husband & I are CPAs & understand finances & are good at negotiating. I realize the agent still has to work to close the deal, but is there anyway to get some of that 3% to go into our pocket?

I also read that a true buyer's agent will not sell a property. Is that true? If so, do I need to get a separate agent to sell our current house?

I have some prospective tenants who have dogs, one of which is a Pitt bull. Even though these particular dogs may be gentle, the fear is that if they get out and injure someone, I, as the property owner could be held responsible.

I am wondering if the following options are wise and if there are other options I am unaware of:

Increased liability insurance.
Have tenant sign a document stating that they alone are responsible for their dogs.

If an apartment is burglarized and neighbors recommend putting sticks of wood on the inside part of a window so as to prevent anyone from unlawfully entering the property..... would that be good rationale for breaking a lease?

A contract is legally binding, but does anyone know about these type of scenarios...

My daughter just moved into a brand new house in a large development in July and it was appraised by a local assessor for $$$$. When she received the second half property tax bill it showed that she only owed $, representing taxes for the land only. Considering her neighbors paid much more in taxes after a similar move in date, we believe the County made a mistake. Somehow the assessors paper work failed to get to the billing department. We have a copy of the complete assessment. Should we let the County know? If she waits until the County discovers its mistake, would she be forced to pay back taxes? Suppose they do not discover the mistake for years? I say she should not be liable for the County's mistake. Gamble and say nothing. What would you do?

We are In the process of buying a house, we had the property we are wanting to buy surveyed (home buyers pack) and the bank (barclays) value the property £13,000 less than the asking price we initially agreed.

I think it is fair to say that the bank think the house is over priced, hence the lower value and amount they will lend to us.

So, the ball is in the sellers court, does he have to lower his asking price to match what the surveyor said?

I guess he doesnt and could put the property back on the market but that means he starts from scratch.

Are the banks being cautious considering the current market conditions?

The overall question is:

I take the surveyors report to be credible and valid, this is my bargining chip, does the vendor have to agree that the house is worth what the bank will lend us?

I've never worked for a equipament and leasing finance before.
is there anybody out there that can give me some good advice on how this company works?


Supervisor told me this: You have to call companies all over the city.. like make 100 calls per day and get at least 3 companies to give you their background information and then summit the information to me and see if they qualify for the loan. SO we can give them over 10,000 $ or whatever money is that they need to buy things . This people can be mechanic, work with airplanes ... and they need money to buy merchandise.
