Ok my husband worked for Co. that we had wondered whether it was concidered agricultral or not? He was never paid time and a 1/2 just straight time. He drove a tractor mowing and spraying chemicals on pine trees. Worked 8/2004-8/2007 he is no longer there but our son in law is and he just started getting time and a 1/2 on his OT. He said they found out they have to pay it now. Does this mean we may be able to collect our back OT pay? We have questioned them on this many times because some employees did and some didn't???? Doing same job. Figured it was worth checking into since it would have been 5.00$ hr for a avg of about 117 weeks.

I have worked at this restaurant for 2 years now. My wage is 9.10 an hour. The problem is I acquired a job for my friend there and he is receiving 9.50 an hour! What can I do get a overdue raise legal wise, EEC? And what pay should I demand.

I have established myself as a reliable employee by ALWAYS being punctual, being very productive, and having great relations with managers. I have worked in this business for four years now. My friend, he is completely new and has no experience in the food industry. You see the disparity???

I took a drug test (urine) for a very good job. At the medical clinic where i took the test,i gave them a letter from my dr. about the medication i'm prescribed. Is it illegal for that clinic to tell the employer about my prescribed medication even if it shows up on the drug screen?

I have just handed in my notice to a horriable job where they treat me very badly, I have been discriminated against for being straight etc. (although they have made it impossiable to gather any evidence of this), I don't want their reference. Anyway, I have said I will work my 1 weeks notice, but I haven't gone in for my 2nd last day and am wondering if I don't work it at all, can they do anything? (other than give me a crap reference).

I'm in the process of applying for a job. I've had three interviews. Now, they are requesting transcripts from all of the schools I've been to after high school and a copy of my recent pay check stub. I already faxed over one transcript and a pay check stub. Then, I get a fax of my pay check stub with circles around certain items--asking for clarification on what certain codes mean. This is supposed to be for the "benefits coordinator." I've never gone through this before. It seems a bit much as they have not offered me the job. What's going on here?

I am a Florida resident, unfortunately unemployed, who is repeatedly being turned down for jobs that I am highly qualified for.I am usually given no feasable explanation for the denial.I am starting to think that this state condones job discrimination and is NOT doing what it can to HELP people like me who WANT and NEED to work.

I am a Staff with Ernst and Young's IT Audit Practice.. I am on a project with a Senior in Minneapolis.. Anyways, when it was time for us to make our flight arrangements, I indicated to my Senior that because there is no direct flight to the airport closest to my house, I may have to take an earlier flight home on Fridays.. My Senior lives near in an airport with a direct flight from Minneapolis.. Anyways, my Senior obliged and I assured him that I could make up the hours from either the plane ride home or over the weekend..
On my way to the airport for my flight back home, I proceed to get a call from my Senior Manager, yelling at me and saying I should have not taken an early flight.. He indicated that the Senior and I are a team and we should be leaving together.. He said he didnt care where I lived and wanted me to take the same flight as my senior.. He said that since the Senior's airport is 2 hours from my house, I could rent a car and drive home.. How is this fair to me???

they were going to fire me I took 12 weeks of FMLA. So I could become vested in my 401k, which I did. I requested from HR that they transfer me to a different location b/f I came back to work. Bu the HR person never responded basically teling me that he had no intention of transfering me to another location to save me additional heartache from this jerk manager. So essentially he forced me to resign my position, I was NOT going to go back into that hostile work enviroment so I quit. Do I have any legal recourse since the HR guy never so much as returned my emails Please let me knwo, what I should do. I am also ABSOLUTELY SURE this Store Manager is telling perspective employers I am interviewing with he is telling them negative info but i cant prove it. I know this is long please help

Hello,

I feel that my employer owes my around $15,000 due to a bonus structure in my current deal, but they are not paying it. Is there anything I can do in the court system to enforce this, while still keep my job?

Thanks

Today marks 1 month that I have worked at my current or now previous employer. As a side job, I am a mortgage broker on the side. However, today they terminated me, because they claim I was selling mortgages, and they claim that the conversation was recorded. I never sold mortgages to anyone. I wrote an e-mail to the people who were there, and asked to set an appointment to come in and listen to the recording. I live in Colorado. "At Will" State.

I work in the airline biz and from time to time we are short of help, sometime people are told to stay "on the job", even if thier respective shift has ended.

Since I am part time and work a 5 hour day, I have to work 3 more hours of 1.0 OT till I get to 8 hours then it goes to 1.5 OT. This seems unfair that I am told to stay, but get payed at my straight time.

We have 2 books also on employee conduct.

The 1st book says that "if leaving would adversely affect operations, you should do the right thing and stay on the job."

The other states that "if operations would be affected by your leaving, it is expected that you would stay on the job until such time as management has cleared you to leave"

Can they really force someone to stay on the job under these circumstancesand not get paid 1.5 OT, why or why not?

Ok I was wondering if this was legal or not.

So i have been looking for a job now for about a month i got
a job with AMC movie theaters when they called me to setup
the interview they had told me I couldn’t have long hair,
piercings, or tattoos on my face, neck, or hands.
I don’t have any of these i do however have 3 tattoos on my forearms
a cross and two stars......so i went to the interview got the job everything seemed
good they asked me to come in a week later to pick up my uniform. So that would make
it 2 times I have talked with these people in person. After which I went in for training
while I was in training with the five other people they hired they told
me I wouldn’t be able to work there because of my tattoos but not before I was in the
meeting for 2 hours. The thing is there was a guy in there with long hair and 2 of the other people that got jobs had piercings but I was the only one too not get the job
Is this legal?

I am just finishing up my first quarter in a graduate program for library science and seriously doubt future job prospects in my area. I don't want to be in thousands of dollars of debt for a degree that may leave me without a job in my field .... Plus, after working at my public library as a circulation assistant, I've found the public service aspect of the career to make me feel very frustrated and annoyed.

Since I also had an interest in the legal field but had no interest in pursuing law school, I have considered abandoning the library degree and getting a paralegal certification (there seem to be frequent postings for these positions in my area).

Is this a bad idea?! I'm so lost and confused!

most times we don't have time to take a full 30 min. break in healthcare, yet they threaten us that they will take an hour out if we do not clock out for 30 min. break or no break. this just doesn't sound legal to me. Shouldn't we be paid for all time on the clock? They are also threatening to take make us clock out for the 15 min breaks; we work 12 hour shifts.
