Maybe I was not clear. I had not missed work. I was forced out due to being a whistleblower. I was out of the state when this transpired.

Normally you would have applied for it, since it's to your advantage. If you qualified but didn't apply, and were put on FMLA by your employer, they did you a favor, so I don't understand what your issue is. They could have just fired you.

Yes...if you have been missing too much work, they don't have to keep working around your schedule, they can force you to take the leave, which as you have discovered, is unpaid.

Before you run and complain about it...understand that they could have terminated you employment and choose not to.
