I have just been given a key to my office. Not a real key, more one of those digital beep thingies that open the door. I was also told that I would be charged the money to make a new one if I were to lose it. Is this legal? They are threatening to sack me if I ever lose it and then not pay for the charges. Please let me know as I cant find any legislation on this.

my passion is to work in aged community care and really want to work in aged care.but in march i was convicted with arson and it is a case of being in the wrong place at the wrong time. i have never harmed anyone and never would im really worried about appliying for jobs because i dont want to be rejected what advice do u have?

On thursday I went in to my work after babysitting and I had a huge head ache. Even the guy i worked with said i looked sick. Well, the next day I woke up to get ready for school and it was there, just 3 times as worse. So, I missed school, and at noon my sister came in and asked me if I was going to work. I never answered her so she called in for me. I then woke at 3, the time I was supposed to go in to work and started freaking out that I was late. But my sister reassured me that she called in for me. So I went back to sleep with the head ache still there, just not as bad now. The next day I'm headed in to work. I have 45 minutes to kill so I go grab me something to eat. I was in the drive thru line for 45 minutes, I was really angry by the time I got to the window. I called and told them I was going to be about 10 min. late, they said okay. I'm not even a mile away and the ass. manager calls and tells me I didn't have to come in. The manager didn't even bother to tell me.

Do criminal background checks for employment usually pick up CHARGES as well as convictions? I was charged with a felony, but was convicted of a misdemeanor instead...I know jobs would see the misdemeanor, but would they also see the felony charge?

I was working for this mortgage company last year for about 6 months. I had set hours, Monday-Friday from 9am-5pm & a 1hour lunch. I was on salary, every single month I got paid the same amount. I recall asking them why I did not have a pay stub showing all my deductions, & why they were not taking any thing out of my check. They told me that this is how they paid all their employee's, (When I was hired I was hired as their employee not as an individual contractor) & that at tax time they would send me a form to do my taxes called a 1099. When I did my taxes I did not need to pay the state any money. I did not know this but apparently employers can NOT do that, they can not tell the government (edd, irs etc) that you are an individual contractor & when in reality your just a regular employee. Now when I called EDD they told me there are no wages that were reported for last year from that employer who had me on a 1099. How can I fight this & get unemployment!!!?

They gave him an ultimatum to quit or get fired.. i can't believe they could do this. is that even legal? can he still get unemplyment? its a really hard time especially since holidays are around the corner. please help!

I feel the company made some very crucial mistakes. I might take this to court. They go by a point system. For a call-out you recieve one occurence. If you are late more than 3 minutes you get a half of an occurence. If you go on Leave Of Absence you get one occurence for up to five days off. And if you tally up 8 occurences within that year, termination occurs! But in the Employees Handbook you recieve when you first get hired, it says: 0-4 occurences you get no corrective actions, your 5th occurence you get Written counseling, 6th written warning, 7th final written warning, and 8th termination! Its company policy to take these corrective action steps. My question to you is, since I got to my 8th occurence they have a right to terminate my employment with the company, but my only corretive action they took was my final written warning. i feel it was unfair that I was unaware that I got this far into my occurences without knowledge of it. What do you think I should do?

Yesterday i made a comment about the office being to warm, and my boss responded with, 'just take your shirt off'. Also in the past when I gave him a check we received from a customer he told me I could have it if I spent it all on victorias secret and modeled if for him. What do I do? I really need this job with christmas in a month. I have been searching for other jobs since he first said the Victorias Secret comment 4 months, and I have found nothing. Also, collecting unemployment is not an option, I barely make enough as is, so unemployment checks definately won't pay the bills. HELP!!!

First, I'm from California. I just started a job that's seasonal for Thanksgiving and Christmas. Just a normal call center job but I work about 11 hours a day. I know I get 3 hours of overtime each day, but after the 4th day, that totals to 44 hours of work already. That's 12 hours of overtime, but in California you receive overtime for every hour over 40 hours worked in a week. That's so far 32 hours of normal pay and 12 hours of overtime. BUT if I work anymore that week, is every hour over that considered overtime, or do I have to put in 8 hours more of regular pay hours to make 40 hours of regular pay hours? Also, when is double pay other than more than 12 hours a day? And, if I continued to work 11 hours for the rest of the week (thats 7 days x 11 hours), how much would my paycheck be if I make $10 an hour without tax taken off?

daughter was fired 4 theft at clothing store. They told her she owes them $8,000 even though they don't know what exactly was taken. They told her she could bring back the merchandise & they would deduct it from her total, depending on its condition. Except everything she will be bringing back doesn't even come close to what they said she owes. What can I do about this? Anyone know? Other employees got caught to but they only were charged $1400, this just doesn't seem right to me. Please help me.....

I'm 26, and my company recently moved into a new bldg that has some finishing work that still needs to be done, so there are a lot of painters, construction workers, etc around. There are a few that have been on my floor regularly, and I have been friendly to them by smiling and saying good morning, stuff like that. I have noticed when I walk by they speak in Spanish to each other and laugh and check me out. I know they are saying suggestive things. Anyway, today I was going to lunch and one of the workers said, "Are you going to help me work today?" I just smiled as I went to my car and he said, "YOu know I'll work you! I'll work you hard!" Then walked away laughing. I was disgusted. I don't want to get anyone fired, but should I bring this up? I feel like they'll tell me I'm asking for it since I often wear heels and things. But I have in no way flirted with them or anything.

I work in a furniture store, and recently have been given a few requirements which I feel are very unfair. Firstly, working stocktake approx. 7 hours overtime in two days, with NO overtime to be payable. Secondly, on Christmas eve, our store will be closed. We have been told by management that we are to take one of our RDO's, or take the day out of our annual leave entitlements, OR we will be given a days credit to owe them later. All this on a day when they have closed the store. We haven't been asked if this arrangement is suitable for us, nor have we signed an AWA. Can this can be enforced legally?

My 3 month old son was admitted to the hospital and had to have surgery, I was off work all week, and I have the PTO to cover the time I was off work. she said the company states grounds for termination is if employee has more than 3 unscheduled days. I had no choice! my son was sick! is this Legal? How can I fight this? I am on a 30 day probation! I can't miss one day of work or I get fired! what happens if he gets sick again? Do I loose my Job? I am a single mother and I have to keep my job! please some one help!

Last year I applied for a job with the Library of Congress. I noticed there was an optional section where you could state whether you have a handicap or not. I noticed it when I had only ten minutes left to submit my application via the internet, so I called their office. The administrator said if I had a handicap, I should DEFINITELY mention it (assuming it wouldn't interfere with the work) since they want competent handicapped people. Then he asked if I had some 'official handicapped' form. I said I didn't, just a doctor's note. He said I needed a gov't approved form. Does anyone know what this form could be?

I started as the receptionist at a Law firm in Cleveland, OH on August 29th of this year. It is a decent size firm-25 or so employees. After only a short time, the legal assistants started to give me a lot of their overflow work. I was catching on qucikly and doing things accurately and in a timley fashon. They loved me. I have since been promoted. They are going to train me to be a probate legal assistant. They started me out at 25k a year as the receptionist. When I accepted the promotion they told me I would be getting a raise, they said they didn't know how much yet though. The average salary for the position in the Cleveland area (between 0-2 years experience) is between 31k and 38k a year. In your opinion, what do you think i should expect to make?

I'm only 17 and it is a part-time job at a non-profit, county-owned theater. I don't know how that effects the situation and the laws or entails but it has gotten rather annoying. My official payday is every other Wednesday but since we're always swimming in debt, they usually don't have the money to pay us (myself and the other ushers.) We are usually given excuses like "None of the board members were around to sign them (our checks)" or "The checks are going to be a little bit late." It doesn't sound legal but then again, I know nothing of how these types of laws work. Any help is appreciated. Thanks in advance.
