I work in a furniture store, and recently have been given a few requirements which I feel are very unfair. Firstly, working stocktake approx. 7 hours overtime in two days, with NO overtime to be payable. Secondly, on Christmas eve, our store will be closed. We have been told by management that we are to take one of our RDO's, or take the day out of our annual leave entitlements, OR we will be given a days credit to owe them later. All this on a day when they have closed the store. We haven't been asked if this arrangement is suitable for us, nor have we signed an AWA. Can this can be enforced legally?

The requirements given are not only UNFAIR, but patently ILLEGAL !!.

Since you have not signed the AWA , it is not enforceable !!!

You don't say where you live. And I have no idea what an AWA is which makes me suspect you are somewhere other than the US.

In the US, overtime pay is required by federal law if you work over 40 hours in a week, not based on hours in any given day although I believe there are some states that do have a daily limit.

The company isn't required to pay you for a day you don't work, and it doesn't matter whether you aren't working because you took off or because the store isn't open.
