I refinanced in october of '06 and pulled 30k... is that capital gain?, is it taxable in any way, it's my primary and only residence and its in SoCal.

I asked this in real estate also...but we are interested in buying some property in Oklahoma, but couldn't locate the owner...after some digging we found that they owe 4 years of back taxes on the place. If we want to purchase it do we have to buy the certificate from the tax lien company or speak with the owner? Any help would be great!! Thanks!

This is a second home. I have owned the land for 20 years. My husband and I literally built this house ourselves. I am thinking of selling but not if I have to pay the IRS $125,000 of my blood, sweat, and tears. So what I want to know is what is the tax percentage on $300,000.
And also is there any sneeky way to get out of Capitol Gain.

I filed my taxes and the irs accepted them on 1/15, said would take 8-15 days. I waited then checked irs.gov for 'where's my refund?' and it said that it would be direct deposited on 1/26. so i waited, checked again on 1/26 said same thing, so i figured w/ the weekend it wouldn't hit my bank til 1/30 or 1/31. checked again at 10.15pm on 1/30 said was direct deposit on 1/26........then checked again at 4.45am on 1/31 and all of a sudden it is now 'a delay in processing my refund'. I called them and they said that they just needed more time. it would be 2-8 more weeks. so how can they do that? deposit it then take it back and why would they?

A friend of mine didn't have enough money taken out of her check and now owes the IRS about $700. She filled out her W-4 correctly to have the deductions withheld but her employer failed to take enough money out. Is this her fault? Does she still have to pay this amount, even though her employer didn't withhold enough money? I figured it out and according to the amount the government requires you to pay (10%), she does actually owe the money, but had her employer been taking out the money correctly, it would have been paid all year long. I told her it didn't matter if her employer didn't take enough money out, it was still her responsibility to make sure her withholding was correct, and thus, her fault she now owes but she insists its not her fault. If I lived in my primary residence less than two years, and received a gain I will have to claim a capital gain. Can I claim a capital loss if I lived in my house (primary residence) if I lived in it less than two years, if I received a loss? Wouldn't the same rules apply?

My ex-fiance claimed the mortgage on his taxes last year. We broke up, and before he left said I could have it for this year. (I refinanced into my name before he moved out.) The interest statement from the old finance co. came to me, but since he is vindictive I'm afraid he will get a copy and claim it on his return. I have a general question. One of my friends in a custody battle with his son's mother. currently no one has full custody of the child till a study is conducted. He has filed claiming his son since he was born, yet now that the mother having hard times financially she placed the child on her tax return. The child was actually living with my friend but not until the mother ran into hard times did she wish to have him back. I was wondering since he has in the past filed with his child included and the child did live with him for the majority of the year other than when he went over to the mom's house, does he have a right to file over her?

I only made 4500.00 this year. I noticed that my employer did not take federal taxes out. Although, they should have.
