I posted a question earlier whether I should wait for another year to buy my 1st house. Got many responses back to wait and to track home values trend on the right time to buy.

What are some good online resourse/website to get informed on where the residential real estate value is heading?

I'm at work currently trying to figure out which kind of law applies to one of our shopping center tenants who is undergoing bankruptcy and doesn't want to pay rent.

I am filing a claim, but do not know if it should be unsecured or secured and under which 11 U.S.C. 507 (a) (_________) priority our trying to obtain October's rent applies to.

Someone out there has to know more on this issue and might be able to help.

Thank you!

My house is currently under construction...we paid $11k for a covered patio and it is totally messed up. The beams are each sitting a few inches off the concrete and the patio is way off from being centered on the concrete slab. I asked our builder rep about it and he said it is structurally safe and that all they can do to fix is to add more concrete but it would chip away anyway. the patio looks horrible and way different then the model home we had viewed before purchasing.

We went to another home site and their model home has the same patio problem but we can see where they added the concrete and its already chipping away (house less than one year)

Is it unreasonable to request any of the following:
A) fix the patio BUT we want a written guaranty that they are not just going to add concrete they KNOW will chip away - we want it fixed right - possibly rebuilt
B) the price of the patio taken off the house
C) our money back in FULL - including earnest money - their fault

My husband & I own 3 lots in a Poconos (PA) community. When we purchased our lots we agreed to the published bylaws. The roads within our community are private & not dedicated to the township. Within the bylaws it is given that each homeowner 'owns' to the center of the road adjacent to their property. The HOA is still under the control of the land developer but scheduled to be turned over to the home owners 12/15/07. Today (12/7) we received notification that the developer has made changes to these bylaws, with no discussion or input from the home owners. These additions basically cover his butt by giving him the right to break through our cul-de-sacs to create roads into another land tract he owns adjacent to this community. When we purchased our lots we were told that the homeowners had a right to not allow entrance to this tract through our community. The developer's changes have taken away this right. Can the developer make changes to the bylaws in place when we purchased?

I am not understanding the mortgage crises that is occuring right now. There are a lot of people who have lost their homes or are about to. Some people lose their houses because they lost their job or were injured and had a change in income unexpectedly...that's different. What I am not understanding is how people are struggling with their mortgages because the rate set....didn't people know when they made the loan that the rates would reset? didn't they question what the worst case scenario would be in terms of their ability to afford the payments? I guess I don't understand the lack of foresight in individuals. What happened?

How can a seller justify price their home $3000 more than the comprable home on sale nearby and the comprable has more bedrooms. If a home is worth the asking price, what is the standard price to offer. Is it $5000 less or more?

I think when I view the property for the first time, I will not only bring an RE expert, but also an appraiser so I can get a better idea on the true value of the property. Has anyone ever did this before?

In most of the rental agreements, the heading is "Lease Agreement'. Where offer and acceptance and terms are stated. Is it enough to make it 100% legal?

I moved to a new apartment in a new state about 6 mo ago. One of the conditions of the lease is that I needed to set up an account number with the electric company which I did.

A couple weeks pass and the electricity goes out. I call the company and they have a hard time finding my name or my account number but after a few minutes assured that they had me on file and there was just a brief outage and power would be restored. Since then...6 mo and no bill.

My apartment complex charges water and trash removal in the rent...my last apartment complex also included electricity. I was hoping I was wrong and didn't check the lease.

Tonight I check my voicemail. "Urgent call" from the Electric Co. I'm assuming my luck has run out and I'm getting a massive bill.

Is this disputable? Can I at least get out of late charges for their part in the error? Do they have to supply me with a detailed bill for 6 mo of energy use? Any advice would be great! THANKS!

I just started my second year lease agreement on the house I'm currently in. The bank that owns the home has been by several times leaving things at our door. Today we got a letter in the mail saying that the home is going into forclosure! Are we protected because of our contract with the lease company? How does that work? If he loses the home, what happens to us if we have a rental contract?

I want to refinance my home loan to get a better rate. I purchased the home 1 year ago and currently have a 30 year fixed at 7.0%. I bought the house for 475,000 an currenty owe 423,000. I worried that the home prices have droped so low in my area because of foreclosures that they won't let me refinance. Also, do you have to get an appraisal on your house before you can refi? Thanks

I moved into my new apartment on Nov 26 and my rent needs to be pro-rated. Let's assume my monthly rent is $1000, and from Nov 26-30, that's 5 days, so my rent for Nov should be $1000 / 30days *5days, or it could be $12,000 per year / 365 days * 5 days. But, my landlord says it is $1000 / 30 * 6 days, because my rent is paid from Nov 26 through Dec 25 and he is pro-rating Dec 26-Dec 31.

First of all, it makes no sense to pro-rate it that way, if so, I should just pay rent on the 26th of every month! Second if you want to pro-rate it based on December, it should be $1000 / 31 days * 6 days (since Dec has 31 days!)

He is threatening to evict me, which I dont think there's a basis for. I know it is $30+, but it is just a matter of principle that I am very upset about. Not to mention, his rental agreement states "if you do not move in on the first day of the month, rent will be pro-rated to the first day of the succeeding month"

I have been working with a mortagage company for over a month, trying desperately to get out of an ajdustable rate mortgage I currently have. They lead me on week after week how close they were to closing. The only problem they said was they weren't happy with the appraisel, so he sent a second appraiser to my house. After about 5 weeks, he sent me an email stating that he couldn't re-finance me, given the way the market is, and I owe too much on the house. The true shocker was when he said I needed to send him a check for $700 to cover the 2 appraisels. I was horrified, and said to him that it seems like a scam because he never mentioned any cost to me, ever. He never answers my questions directly when I ask him why, (such as why did he send 2 appraisers, fed me lines for weeks, and never mentioned cost to me) yet says he will sent me to collections and it will ruin my credit. Was I possibly scammed? How do I handle this?

Thanks so much for your advice.
