Can a war criminal who is a naturalised Australian be extradited? Isn't it unconstitutional?
Question Details: Hi, I'm confused, I'm reading about Vasilkovic V Commonwealth (2006) HCA 40 and I'm confused. This guy is a naturalised Australian, but a war criminal. If the extradition act says he can be extradited, how is that unconstitutional when the only reference to the consititution is S51 (xxix), which refers to the Commonwealth having external affairs powers. How can he claim he is being denied his liberty by 1) being arrested and 2) being extradited?

I know it sounds ridiculous but terrorists will stop at nothing to instill the highest levels of fear in a population, paticularly the UK which is Al Qaeda's number 1 target at the moment.

First of all Iran has no nuclear weapon and they are not developing!

let me tell a sad story!... Iran-Iraq War ( known as the Imposed War ) started by Iraq and protection of every single country in the world (US n UK n etc ...were quite unhappy caz of the Iranian revolution which happed 2 years b4 that, caz they could benefit of oil no more)...

well,the war started!... God damn Sadam got the weapons INCLUDING nuclear weapon from US and others...Iran only had the ppl who went to fight for the country... they died , they are still dieing caz of the effects of Nuclear weapons!! (My dad's friend just died caused by that! 17 years after the war!!)...

THEN, Iran thought if we had the same weapons, we could defend ourselves at least... they started to think and build the weapons themselves by their own knowledge.., that was the end of the war i guess... and they started on working nuclear power just to have the knowledge and power!... but not to develop Nuclear power!!...

I got back from Iraq, March 2005, after spending 18 months on active duty, and one year of that in Iraq as a medic, Arkansas Army National Guard. Every company that I have worked for since has layed off all us Americans and rehired illegals or out sourced to China One of the companies is Mohawk rug and textiles. The onl jobs I can get now are through a temp service Staffmark, that acts like they are doing me a huge favor sending me out on jobs that pay $8.50 an hour, with no medical benefits. So, is this the Republicans plan for America? And what is po' little goerge gonna do, with this situation? Is he going to blame the vets, like he did Max Cleland, John McCain, Kerry, Al Gore, John Murtha, and others that served our country with a hundred times more honor than he ever did? Boy, you people that voted Republicans are nothing but a bunch of SUCKERS!

I think he has done a good job. He believes that we should be on the offense instead of defense. If you do believe he is out to destroy our country, why do you believe that? Clinton did a lot of harm to our country by not going on the offensive, but I don't believe he intentionally tried to harm our country. Do you think Bush is harming our country by things he is doing or not doing? I believe he is doing as much good as he can, but I would like to hear all opinions.
