my husband and i are going through a nasty divorce and nothings been mentioned about our taxes, i was a stay at home mother of two he worked. does this mean he gets to claim thenm since he deducted them on his paycheck or do i since i take care of them? we live in ga.

I was in a car accident and incurred 7600 in medical bills not including my copays I had already paid and prescription costs. Since it was related to a car accident my medical insurance demanded I reimburse them.I received a settlement from the at fault parties auto insurance company. And with some of that money I was able to repay my medical insurance provider. Does that money I had to reimburse count as tax deductible medical expenses or am I asking for it if I claim that?

My accountant told me that if I file as married but filing separately, I cannot writeoff the investment condo depreciation? He is stating that as a single or married but filing joint are allowed to get beneift of my real estate investment depreciation; however, the tax law prevents this beneift for individuals that are filing as married but separately? Is this true?

He pays in every year, and he receives 1099 misc. on all his income. He reports everything. I haven't worked for 8 yrs, and would like to work in the office and get paid from him, and at the end of the year he also gives me a 1099 misc. for income I made from him, like he gives to the others that sub-contract from our company. His biz is (Sole Proprietor)

I am disabled and I have received a W2 from the insurance company paying my claim. This is the first year I have been disabled. The wages are listed in box 12a with a code of J. The "third party sick pay" box has been checked. This is the only place on the W2 that the earnings are listed. My question is this "Are these earnings taxable"? I have researched the question and have not found a definitive answer. Jerry

I have 4.2 million dollars that is being held in Africa b/c I dont have $40k to pay them in taxes., I asked them could the take the money directly out and they said no. Is it even legal to run a business out of my apartment? I know that a tax certificate says "This Certificate Must Be Prominently Displayed At Your Place of Business" What if my business is run from home? I do not understand why a national sales tax is not instituted in this country. This would be the best way to generate income on a federal level. Even drug-pushers, and organized crime woul dbe chipping in due to the fact that anything they buy would be hit by this tax. It also forces those who consume more to bear the brunt of the load (i.e. wealthy and expensive lifestyles will supplement more based on their participation - buying more expensive goods and services).

we bought land and built a home in 2000 as primary residence. we had to relocate due to job as of July 2006 and placed the home in service as rental as of 7/1.
a) for depreciation against rental income, is our cost basis the actual cost of the house when built + improvements or is it the current fair market value cost of the house? Both the property land value and the home value have significantly increased since 2000.
b) is the depreciation taken on Schedule E
