Legality is one thing. Safety is another.
Here in PA I've known people who've been busted climbing next to highways. One guy I know as busted b/c he was trespassing. The others I know were not trespassing, per se, b/c they were climbing on public property, but did get fined for illegally parking along the side of the road.
In VT where I used to live it was quite common for people to Ice Climb on roadside waterfalls and frozen seeps. I don't know of anyone ever getting busted there.
However, that rock ledge that looks so nice along the highway might not be a good thing to try. Often it is blasted rock. NJ and Southern NY is mostly sedimentary rock and that stuff crumbles and breaks very easily. Sometimes you'll get lucky and find a spot where the rock has been blasted right down to the hard bedrock. That's stuff you may want to climb, but the majority of stuff along I-80 in NJ and I-87 going into Albany is not worth climbing.
If you live in that area you're much better off just driving up to the Gunks or over to the Water Gap for the day. There are even crappy places in the Water Gap where the rocks break right off. Not the main walls, but the stuff in NJ by Rick's Rock. None of that stuff was ever blasted and it still falls apart.
The cool part about getting busted for climbing is that it makes for a good story and you can keep that issue of the police blotter tacked to your refrigerator door. Most you'll get is a fine unless you are violating a law that specifically prohibits climbing. Then you might get community service or something stupid...usually just a fine.

Legal? That depends if it's public or private property. From what I've noticed while visiting, public property is very difficult to find in the United States.
I think the main issue is safety. Most rock that is right beside the highway has been blasted, making it unsafe for rock climbing. There are pressure cracks all throughout the rock!!!! Don't trust blasted rock!! It's probably ok for ice climbing though...
I suppose top-roping off of a tree or something up top, would greatly increase your safety margin, but for leading I would say absolutely NO.
