The reason it says "if used properly" is because this is a disclaimer. It helps protect the manufacturer and the retail seller from subsequent lawsuits in which the product has been improperly used - applied incorrectly, used for the wrong purpose, etc. - and there has been a poor or harmful outcome.
Believe me, condoms can be used improperly.

It's a disclaimer. It "absolves" the manufacturer of responsibility from improper usage. Yes, condoms can be used incorrectly. You can put it on inside out. You can use an oil based lubricant which breaks down the latex and makes them break easier (use only a water based lubricant). You can put it on too tightly and not leave room in the tip for collection of semen. The list goes on.
By the way..condoms DO expire. Always check the expiration date before using.

In case someone uses it improperly (used it and turned it around, only used it on the head, put too much lube in it and it slips off, etc.), Trojan doesn't want to get sued by a flock of baby daddys.
