Some jurisdictions do it differently. Citations are written according to time of violation. My citation sequence was, Initial violation, license, insurance, or seat belt violation if applicable. DUI, DUI over the legal limit (two separate citations). Charges can also be added in court if the States Attorney feels it;s necessary, and the Judge approves.

Putting the results of your BAT is not adding a charge but making a specific comment on one of the tickets already issued!

It would be like writing a ticket for speeding and putting speeding down as the offense...then adding what the actual speed was!

Just like on the DUI ticket (charge) you're not adding a "charge" but clarifying or describing exactly what the specific offense was!

Perfectly acceptable. There is nothing that says when a citation has to be written. They obviously can't record what the breath test results were until after you take it. It's very common in North Carolina (almost every DWI is done this way).

It doesn't matter when they write the citation or add a charge while at the department. As long as the charge fits the crime.

ALWAYS REFUSE TO TAKE THE BREATH TESTS!!! this way they have no actual evidence that you were even drinking, much less driving under the influence!~!~!
CASE, DISMISSED!
