My niece and nephew are living with us because their mother is in a transition finding a new place to live. My niece seems to have some sort of chronic bronchitis. Her brother was allowed on medical when he was with his mother but she was not because she is the dependent of a marine. He deploys to Iraq in February and has yet to fill out the proper paperwork to get her health insurance and a military I.D card. I cannot afford to add her to my health insurance because they want an additional 600 a month. What do I need to do to get her the military insurance she is entititled to as a dependent of an active duty military serviceman?

the marine is on the birth certificate and pays child support. He has taken a paternity test declaring his as the father.

Find out who his CO is and contact them. Let them know that he has not gotten her an ID or enrolled her in DEERS to your knowledge, he needs to get mom a poa as well (medical) and she needs to give you one if you are not her legal guardian.

The military does not take personal who neglect their families lightly. You may have to jump through several hoops, Mom as well, and it may take some time but you will get your man. (If he's paying child support, etc as you say then she is considered his dependant and is eligible for Tricare and United Concordia Dental -- enrollment and id takes less than 24hrs to process but it sounds like he needs a little encouragement to get it done)

You will have to take her father to court before he leaves for Iraq because once he leaves you will have to wait until he comes back for any other legal action agaisnt him.

You have to get paternity claimed if it is not already. Then go from there. Find a lawyer who is knowledgeable in Military Law. No matter what your neice should of been allowed on her mothers insurance, something is wrong with that picture but anyways your next step is going after the father then. You need to take it to the courts cause if he waits much longer you won't be able to do anything until he returns. Not sure you can do this unless you have temporary custody of the children otherwise the mother will have to do this. Is the father not paying child support or anything like this?

Once you get her on his insurance, Tricare, you will be able to have her be seen on a military installation, if you are close to one. Otherwise you will have to pay a copay when you bring her to the hospital unless you take her to the ER. And once she is on DEERS (military paperwork to get her on medical and other military related benifits) he can get her added for Dental Insurance which will come directly out of his pay. But he needs to sign up for that himself, and you can't make him do this.

Hope you get this settled soon before he leaves cause time is running out.

is there a court order in place declaring him responsible for providing her medical insurance? If the child is not enrolled into DEERS, then she is not entitled to Tricare. Whether or not she is eligible to be enrolled into DEERS is another story.. is the Marine in question her declared father? name on the BC, etc? if not, that's the first thing that needs taking care of, second ids the court order making him responsible for her medical care. it is NOT automatic, and the military does have the right to require a DNA test if there are any doubts..paid for by you.

If she is not the biological child of the Marine but was covered becuase her mother was married to the Marine, that covereage ENDED the day the divorce became final.

the soldier has to fill out the paperwork. if he won't do it, contact his CO--he will ensure that the soldier has everything in order before he ships out. sometimes, that is the only way to get the younger guys to get stuff done (going to their CO). a lot of times the younger guys don't think of important stuff like insurance.

The military member has to get her a dependent ID card and enrollmentin the DEERS data base. You cannot do it; he has to.

Go to the Marines CO. Get him to take care of his duty to his family. Believe me, his CO will give him the kick in the a** that he needs to take care of this problem.

The marine has to enroll her in DEERS. You can't do it.
