Many jurisdictions adopt the latest edition of the NEC as soon as it is approved, but some adopt it later. You need to check with the authority having jurisdiction to be sure.

It depends on the location.
Just finished helping a family member wire his house.
Found out the the hard way that local reg.s used
the 1999 Code.

the 2008 code books are current and was approved this past August.
