That only works if you can prove you were fired because of your cancer. Your employer knows this. If you really trully were fired because of your illness, I bet your employer took means to cover his butt. It will be difficult for you to get anywhere.
Then if you were employed at will, they can let you go at anytime for any reason. They will not cite you being sick as the reason, but with at will, they really dont have to cite a reason.
Truth be told though, I know money is a huge factor here, but if you are in treatment, you really should be at home resting anyways

I am 55 and have advanced prostate cancer. My meds, follow-ups, and scans, if I did not have insurance paying for this 100%, would run me $30,000 a year or more.
My company has a policy that if I have to go on disability for long term treatment for more than 6 months in a single year, such as 6 months of Chemo with complications, I am automatically terminated. It is considered "assumed voluntary termination". I talked with a lawyer and there is nothing I can do because I signed a paper when I hired that I would agree to HR policies as a condition of employment.
SO I HAVE A FOLLOW-UP QUESTION ON THIS TOPIC. If I do get terminated, what are my insurance options long term? I am employed by the HMO that I am trying to keep. I have worked here 18 years. I know about COBRA, but I also know it is expensive insurance and won’t last more than 18 months. Anybody want to answer this? If I lose insurance coverage, it is a death sentence for me.

You are protected by the Americans with Disabilities Act. Cancer is considered a disability.
Did your supervisor/manager know about your condition?
Do you have copies of your last few performance reviews?
What were the circumstances of the restructure?
