If he goes back to his country to marry you he will be barred from coming back to the US for 10 yrs. If he came here on a visa in his real name and was inspected by an immigration officer (and he doesn't have any criminal background)then you can marry him here its easier, will cost you well over $1000 in filing fees and if he may get his paper works within a year

My husband and I have been married for almost 3 years and he is illegal. We got married over here in the United States. We are now applying for the I130 after being married for more than 2 years. Its harder to get him legal right after you guys get married, because of the false marriage of a U.S. and illegal for just the benefits of being legal. Maybe you should try to get him legal before you guys get married, its a lot essayer on both of your parts as married people. We are also living in Mexico at the time of waiting on results of the I130. Its a stress on both of us, but I wish the best on your love. No matter what don't let the ¨Illegal¨part stop you from loving the person.

I believe it's better to marry him in his home country. The best advice is to goto a lawyer. Some of us speak with out knowledge and frankly I'm one of them.
My issue is that if he is not legally here, Immigration knows this by a lack of documents. How are you going to answer how he got to the US to marry you with out a visa???
I was told there is two alternative and I'm not sure which is best . Either you marry him over there or to send him home and apply for a fiance visa.

I agree with 'myself' :) If he leaves the US, he may be banned from re-entering the US for 3/10 years or for the lifetime. Consult a lawyer first, marry in the US, file form I-130 for him and during the interview ask for form I-601 (waiver of deportation).

Send him to Honduras and start the process from there -fiance visa- but do not get married in Honduras unless you're not planning to move to USA as a family.

He can no longer file for legal status while in the US. If deported, he will be banned from the US for 10 years.

Either way it will not be easy. Talk to a good lawer for advise. If you do it here he will most likely be penalized. If he goes home the wait period might be overwhelmingly long.

taxes is your biggest concern chances are you will get hit with back taxes and penilties... just becaus you get married doesn't mean he is leagle..you still need a lawyer to help file paper work with the proper agencies. anyway you need to start with an application to the Immigraton burue.. if you go to handuras good luck coming back.... together.. or getting out ... criminal

the latter would probably be faster & safer--you're not breaking any Honduran laws by marrying him there, but he is breaking a law by being in the US illegally
