My friend was a tourist who enter legally to the U.S. and got his driver license with his passport. He was supposed to stay here six months but he decided to stay, he has been here for 7 years, he didn't have any crimminal offences his driving record is clean and he is studing in a community college and he was about to transfer to a public university, he was arrested for dwi 2 weeks ago, they didnt know he is undocumented, his bondman paid 1000 to take him out of jail, and now he doesnt know if this is going to affect him permanenttly if he applies for a green card. My question is the following: if he just got one dwi is that reason enough to deny him the residency? is he going to be deported?, is this dwi too serious for an applicant for residency?

You're friend is an illegal immigrant. Practice saying that. I hope he gets deported.

He can not apply for a greencard. He is currently an illegal alien. If your state is one that checks for status and he comes up as out of status, he WILL be deported. He will be banned from reentry. He SHOULD be deported. He has no legal right to be here. Tourists who overstay their visas are committing an illegal act. If a person has a visitor’s visa and then overstays by 180 days and then leaves voluntarily, there is a three-year ban on coming back to the US. If one overstays a whole year and then leaves voluntarily, there is a ten-year bar. Also, there is the possibility of being apprehended and being placed in removal proceedings or actually being removed from the United States involuntarily. Therefore, the penalties that apply do depend on the circumstances.

Of course, he will be deported. He is a criminal illegal alien and with him being here illegally and not obeying the laws, he will soon be gone. Yes, a DWI is a very serious offence. How would you feel if he hit the car you were driving in with your children and injured one of them?

A DUI or not your friend can not get a green card because he is illegal. He needs to go home after he deals with the DUI and make a new life for himself in his country

Your friend became an illegal alien at the point he/she overstayed their visa. Your friend is a deportable alien regardless of the DWI charge.

I am a legal immigrant, and it cost me a lot of money to pay for lawyers etc. I pay my taxes and keep my nose clean.

He should be deported.
