I have a 17 yr old son whos on child support and has alot of back pay. I wanted to know if I can still file income tax for my son even though he owes child support. Will child support take the check even though I file with him??

If your child is depending on you, is a dependent ... lives in your home, eats your groceries, uses your electricity, then yes, you claim the child as a dependent.

Does the child support pay for ALL these expenses?
I suggest you use some place like G+R Block to figure out your taxes, since the person paying child support might also want to claim your son as a dependent on that basis.

Are you promised more money, not yet received?

You can file papers with the IRS saying that the deadbeat Dad still owes you _____say how much $, this will result in the ISR going after deadbeat Dad for the taxes on the income you have not yet received.

Child support is not reported as income on the tax return. You can claim your child as dependent.

If your son did not support himself, then yes, you may be able to claim him as your dependent (he also must live you). The refund is yours, not his, so if he owes for child support they can't take your refund.

If he had income, he needs to file.

You can claim him as long as you are eligible, and his back child support won't affect your refund - it won't be taken for his debt.
