That's one of the most wanted updates for PS3, Sony is working on it. Sony never announces the date of updates nor the contents of the next update.

Sony might have a future update so that you can access the XMB while playing a game, but really it's not a big deal to me. I prefer to listen to the music that the game already has anyways. Some game developers spend big bucks just to produce custom/original music for a game.

That really isn't a patch, so much as it is the game maker's choice to have that feature. All of the games that are made could have that feature, but when you spend big bucks on a a custom soundtrack, why have it be drowned out?
