I got completely smashed last weekend, and I got arrested...I don't even remember it. They took me to jail until I sobered up, and a friend picked me up (my bail was free). I'm only 19, and I didn't get charged with underage drinking, but is the judge gonna be harder on me for being underage? Should I get a lawyer? What kinda fines am I looking at, and am I gonna go to jail or have to do community service or something?

I live in North Carolina.

I was charged with being Intoxicated and Disruptive. My court date is January 31. I was just saying that my papers don't say anything about me being underage. The charge is "Intoxicated and Disruptive."

Don't know what state you live in but the officer should have charged you for " Possession of an Alcoholic Beverage under the age of 21 and Disorderly Conduct. He/she could still charge you but most of the time the charge is done at time of the incident so the magistrate can sign his/her citation and send it to the clerks office after giving you his release orders. ARE YOU SURE YOU WERE NOT CHARGED? If you were not charge then you don't have a Court date to see a District court judge! Something is up with this question.

You could still find that you have a charge against you for underage drinking. The District Attorney could file the charge if there is evidence. You will probably be fined for the Disruptive behavior.

If you lived in Illinois, then your fine would be about $750 and your have about 50 hours of community service. No jail time, the night you get picked up is your chance at jail.

A lot of courts these days have "Sobriety Court." You'll probably have to go to counseling and stay clean of alcohol and drugs - random testing. I'd expect community service and a small fine, but no jail time. You'll probably get about a year on probation too.

hey you pay some fines. and the judge might still charge you with underage consumption.
