There is no reasonable expectation to privacy with a recorder used in person.
There are state laws which prohibit the recording of telephone calls under certain circumstances but most officers utilize recorders to protect themselves from frivolous and erroneous complaints!

If you are under arrest and in a custodial situation, you bet they will probably be recording you and if in the station, there are usually signs posted all over the walls and the doors of the interrogation room advising you that there is audio and video surveillance being conducted. The only time they can't record you is if you are in there and it's just you and your lawyer and he is providing you council, that is protected conversation. Also, in most states, the law provides that as long as one person involved in the conversation, usually being the cop, is aware that the recording is taking place, it is allowed. A traffic stop where there is a dash cam and a mic on the officer is a prime example. But if they put two people, suspects for example in a room together hoping they speak freely and incriminate themselves, and there is no notice posted and they record you, anything they say would most likely not be admissable in court.

where? Over the phone or in person? On the phone..yes if he is part of the call. NY is 2 party state. otherwise, no, without a court order.
As far as in person, yes they can. You have zero expectation of privacy in public.You can be taped and filmed anywhere in public and in NY, you are on camera and recorded many,many times a day. Video surveillance has become the detectives new best friend. They are all over and a good percentage of crimes are caught on camera, like the recent murder of a NYC cop and the murder of two aux cops. Cops wear wire all the time in various capacities. Dash cams have mics the officer wears. Plenty of people have found that out the hard way when they make an accusation against a cop and the dash cam shows the real story. The person is then arrested for filing a false report.

a police officer records conversations for his protection and also to help write his reports.... any time you are speaking to a police officer, expect for everything you say to be recorded. yes its legal and in most departments it is department policy that everything be recorded and saved for future reference.

I don't know the truth, but for some reason I always thought that if they don't notify you that you are being recorded they cant.... but who knows?
