I live in the US, He still lives in France. We want to live in the US together. I am planning on going to meet his family with in the next couple of months. In return, we are wanting to come back here so he can meet my family, and we can get married.

The above answer is correct, it depends entirely on where you want to live after you are married, the U.S. or France?

It also depends if he is already in the U.S. or if he is France and if he is in the states then which visa is here with?

If he is in France, then have you met each other, in person, at least once in the last two years?

The answers to the above questions will determine which route is best for you take - the K1, CR-1/IR-1 or a simple adjustment of status.

It is rather straight forward then. He can return to the United States with you without the need for any paperwork to be filed. He can enter on the visa waiver program and you can both legally marry once you arrive in the U.S. Once you are married and have the married certificate in hand, you then need to file Form I-130, Petition for Alien Relative. Your then husband would need to return back home to France at the end of his authorized period of stay in the U.S. (the date indicated on his I-94 in his passport), were he would await the processing of the I-130 and in time attend the CR-1/IR-1 visa interview at the American Embassy in France.

This whole process from the filing of the I-130 should take around 7-10 months, so you will be apart as a married couple. The period of separation is unavoidable in these cases. The total costs will be around $2000.

Depends on where you live France or the USA.

If in the USA, getting married is the easy part. Getting him a K-1 visa is the hard part.
