Jimmy F; i dont want to live in Africa, my children have a home here im not taking them from what is familiar to them.

Frustrated: i didnt support him with the overstay, i didnt find out until the day we applied for spouse visa!
its just the waiting its very hard, especially for our children.

and they do keep putting obsticals in the way. we were told the visa iss definate that he's waiting it to be processed, then they come up with stupid things like we have to prove were in a relationship. what more can we prove? we have photos, letters, cards, birth certifiacte for child, marrige certificate.
sorry i like to complain about it im just soooooo fed-up with being messed around!

looks like our only option is to wait it out then.

Hi Fudge cake,
As others explained the visa waiver program is for entry to the US and will not allow you to circumvent the process of visa application for the UK.
We know that your husband previously overstayed his visa as you have informed us before, unless you were supporting him he would have been working in breach as well. It will take some time to investigate his claim to a spouse visa, given his poor immigration history - if you have already been through the process and are now appealing then you need to find out how long the wait is currently for the process to complete.
There is no route for him to the UK other than waiting. I am sure that you will eventually be together.

A Visa is something that you have to apply for to enter a given country...permission to be there.... A visa waiver is something that allows you to enter the country without "officially" having a visa. Some countries don't require a visa as long as your stay is under 30 days/90 days, etc... some countries allow you to apply for, and receive a visa when you arrive at the airport. I'm not sure if the UK allows this situation. Some countries have suspended the program. You would need to check a government website for specific rules and regulations based on your country of origin (what's stated on your passport) and your ultimate destination. When you are transitting an airport or country on an airline connection flight, you don't necessarily need a transit visa.... You definitely need to double check with the UK consulate office or run the risk of being deported.

The Visa Waiver Program (VWP) is a program of the United States of America which allows citizens of specific countries to travel to the US for tourism or business for up to 90 days without having to obtain a visa. All countries participating in the program have high HDI and most are regarded as developed countries.

I don't know about visas to the U.K., but here in the U.S. they only have visa waivers for "rich" countries like Western European countries and Canada. I know: It sucks!
