yes that is correct. when children are involved, one (usually the senior) gets BAH w/D and the other one gets Single BAH.
Perfectly legal and aboveboard.

That is the way it is supposed to be
When a couple is dual military: One gets BAH single and the other gets BAH with dependents.
Remember they are both working and BAH is part of there compensation for that work.
I think that there should only be one rate for BAH. There is no reason why single people should get paid less in the military.
In the civilian world that would be illegal.

It probably isn't right but they are doing it and getting away with it so for now until they get found not being right then bah, bah-dep and bah-s, listing the wife in the les and being a bah is alright but tell them to be careful from now on.
Is there a way of finding out for sure by phoning anonymously tell them the story and say what if.....? Would that work?

I am confused with your question, especially the part where you say "the other one is claiming BAH-S and lists the wife in the LES and being a dependent" If the wife is in the military they should not be claimed as a dependent.
Go to this website
http://perdiem.hqda.pentagon.mil/perdiem/bah.html
The regulations are on that page.
I am in the Army and have worked with Family Travel and Joint Domicile overseas for 4 years and would like to help you but I dont understand what you are asking.
Call your installation "family travel" section. They will know the regulations and MILPER messages and suppliments to the regulation and they will be able to help you out.

I'm married mil to mil and you both get BAH, my husband had a daughter from another marriage so he gets married with dependent rate and I receive single rate BAH. If neither one of us had children then we'd both receive single rate BAH. There is nothing wrong with both of them receiving BAH because that is how the system works. And it doesnt matter about rank, because I outrank my husband and he still gets the with dependent rate because its his daughter, we just had a baby together 4 weeks ago, yet I still don't get the dependent rate (even though I'm her sponser and she's under my social, because only one person in the marriage gets the dependent rate)

Yes, you will just receive the BAH rate for your location. Are both in the military? You would only get BAH for your housing. I think you are think about BAS when you are talking about dependents and children.
For those non-military BAH is Basic Allowance for Housing.

If the question is for a married couple with both in the military, then one gets the Housing Allowance at the with Dependents rate, because of the children, the other gets the single rate housing allownace. They both are entitled to housing allowance.

ok - this is the deal. He possibly does draw BAH-D (consumer-friendly Allowance for Housing with Dependents), except you're occupying government housing. If he does, he in all hazard attracts it in line with based area (the place you're) as a results of fact, if he's in "A" college, he possibly has no longer reached his first everlasting accountability station. The undesirable information is that the paycheck is his, and whether he has an criminal accountability to help his dependents (the army mandates that one and all workers can help family members), the army won't be able to rigidity him to deliver your cash. it fairly is a civil count wherein the army won't be able to grow to keep in touch. inspite of the undeniable fact that, he can get in complication for violating an order or regulation. The undesirable section there is that he might basically lose money, it is short adequate for a in basic terms-beginning youthful relatives. Calling the Commanding Officer isn't the main marvelous answer, as you will possibly be re-directed to the workers or criminal Officer, who will in all hazard inform you quite plenty what I even have. Your perfect wager is to talk to him quickly, and between the two certainly one of you, verify your funds and set aside very own allowances for yourselves. He can touch his Command financial expert to help get that finished. If he nonetheless desires to act like a irresponsible newborn - I advise you attempt to touch his Command grasp chief. CMC's are extra perfect geared up to suitable motivate youthful Sailors into doing the main marvelous concern, and are much less possibly to bypass the dollar. they are effects oriented. good good fortune.

Dual military couples with children,
Both recieve BAH.
The higher ranking member, recieves BAH at the with/dependents rate.
And the other service member recieves BAH at the single rate.

One or the other gets the entitlement, not ever both. Since BAH goes by paygrade and location the one that is entitled to the most should be claiming it. If both are claiming it, sooner or later Uncle Sam will catch up to you and don't be surprised if you wind up facing fraud charges and one or both get NJP or discharged dishonorably.
