give tickets/ fault to people making left turns when an accident happens? Because I was in a car accident today...it was already after sunset around 5:15 and everyone on the road had their headlights on except this lady...I was making a left turn and didn't see her because she didn't have her headlights on. Usually after a certain point in a day, people tend to focus on lights...inside of trying to make out shapes of cars. But I still got the ticket. Kind of makes me a little mad.

Your statement in regards to focusing on objects after a certain time could cause you to lose your license. It's a good thing the woman wasn't driving a gasoline truck. You may want to consider a different defense..

Hey everyone is in titled to an opinion. If you feel that the lights were a factor contributing to the accident seek an attorney who works accidents. Having a witness will be good to take with you! For once let the courts work for you. At least, let the judge here you side of the story. Who knows, the judge might see that if all the other vehicles had there lights on then it was probably to dark to drive without them. Reason being of having a witness to all other vehicles using there lights. Of all the answers you receive remember, they are opinions. This what court is for.

The ticket is nothing more than an officer's interpretation of the events -- they are not set in stone. When you sign the ticket, you are not admitting guilt, just agreeing to take care of your obligation through court, traffic school or paying the fine.

My advice to you is to collect as much evidence as possible. Take pictures of the scene at the exact time of day the accident occurred to help illustrate just how dark it was. This will help when you in court. Do some additional research online for similar cases and proceed accordingly.

Do you really want to tell the Judge that you could not see a vehicle at dusk simply because she did not have her lights on? Judge might just send you to the DMV for an eye exam. Not much of an excuse or defense. You failed to yield the right of way and caused an accident, it's that simple. Be glad no one was hurt. Pay the fine. . .

Part of the accident investigation process is to determine if any traffic violations occurred that may have caused the accident in the first place.

The bottom line is that you failed to yield the right of way to oncoming traffic and an accident resulted.

If the lady hit you and you were in front of her you should fight it as always prevails to win when ever one hits the car in front of her/him that person always looses you should fight it

I would fight the ticket. Bring in a newspaper that shows sundown at where you live on the date it happened. Any witness that saw that you could not see the lady. Was she old, bring that in. Ask the officer what the conditions were.

Yeah, basically the person turning has to yield to the person going straight. "I didn't see her" is no excuse, lights or no lights.
