How did you dispute this? I would suggest obtaining a copy of both yours and his drivers license, SS cards, and birth certificates. Ask them to remove the information. Here is their contact information.

The BBB has absolutely no authority to do anything. The credit bureaus are governed by the FCRA. Check this site: http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre21.shtm

Is it just your brother's name showing on your credit report, or is his credit information also showing up? Send a letter (certified mail, return receipt) indicating that you have made two previous attempts to get this corrected. You might want to enclose photocopies of you and your brother's birth certificates and /or Social Security Cards to prove you are two different people.

The BB B is a franchise, just like Wendy's, forget them. Go to www.creditboards.com and register, they will not spam you, the only email I got from them was to confirm my registration. They have many subject matter experts and step-by-step instructions on disputes. You can actually lodge a complaint with the Federal Trade Commission (www.ftc.gov) if they break the law (credit bureaus). The creditboards.com forums are PACKED with free info.
Good Luck
