Every soldier is educated on the law of land warfare. One of the prime examples used in the class is the soldier's responsibility to refuse illegal orders.
Taking that into account anyone that orders a murder, along with anyone that carries out such an order is to blame.
Just remember not every death in war meets the definition of murder.

Anyone involved who actually knows it's murder is guilty of murder, whether giving orders or pulling the trigger.
If the person pulling the trigger doesn't realize he is doing wrong by following orders he is not to blame. If he does and goes ahead with the killing it is murder. Same with all involved.

No one is blamed for murder,
they are accused, tried / prosecuted
and IF found guilty face the penalty handed down in a
Court of Law or by Military Tribunaral at a Court Martial.
The excuse of "just following orders" is not a defence, and seeing as you cite no actual case then its hard to be more clear.

That is called an unlawful order. If the person follows it he/she will be charged with murder.

Under what circumstances? In war like conditions there's no such thing as murder persay. Innocent people die during war and that's why war isn't a good thing.

Both people are to blame. The person who gives the order, beause he shouldn't be giving such orders. He shouldn't be enouraging people to murder.2-person who follows the order should realize on his own that it is wrong.
