Sometimes it's safer not to send anything back to the kitchen. Having eaten in many restaurants within view of the food preparation areas, I've witnessed people doing stuff that definitely violates all ethical behavior and health regulations. Knowing that, the few times I've complained, I carefully watched what changed when plate returns. (I don't eat the food on a plate that's returned to my table.).

In one case I examined, the burnt part of the pancake looked as if it had been wiped with a wet kitchen towel, the better looking side of the pancake turned up and the plate sent back to me. If he spit on it, there would be no way I could detect that.

In another case at a bakery I once frequented, the woman was hostile offering me another pastry but upon returning the next day I saw the same batch of overcooked muffins (scorched black on the bottom) still in her display case for sale. The woman who was once friendly had become hostile. (I misjudged her and thought as a small businesswoman she would welcome my feedback about the merchandise) Needless to say, I have never returned to either place because I can't support that bad attitude. . There are too many other restaurants who respect and treat customers better. I'd prefer to spend my money there.

If someone spits in someone else's food there could be harm. That person could have had really bad germs, which the other person can get. Its not safe to eat something that has been spit on. Aids can be a factor, and who knows what else, there are so many things that can be spread through saliva.

Some diseases can be spread through saliva, for example Hepatitis B...but for the most part you're probably gonna be ok, it's just really gross

It's gross. But it can be dangerous if the spitter has Hepatitis, the flu, pink eye, or other very contagious disease.
