Does anyone know the deal on this situation in Kansas? What about if the creditor violated the FDCPA by divulging my business to a third party without my permission? Can I press them to leave me alone until I can get caught up on that basis? Does a creditor in the state of Kansas have the right to repo or do they have to do a replevin filing?

First, if they violated your privacy, you may have the right to sue them or make some regulatory complaint in a separate action. It does not change your original contract.

Second, it depends on your contract. You may have waived rights in the contract. If this is a car, they hold the title and don't need to ask anyone; they can just take it.

Kansas is a right to cure state. They need to send you a written notice (only once).
