In order for a magic spell to work two things must be true:
1.) The recipient of the spell must be aware of the spell.
2.) The intended effect of the spell must be psychological in nature.
In other words, if the "spellee" is aware of the spell and can make the spell "come true", then the spell can work.
An example could be a spell seeking to make a person ill. If the person is aware of the spell and believes in its power then he will be able to report symptoms that could be interpreted as illness. The spell appears to work, but the recipient is the one who is really causing the magic to work. This is done psychologically, not through any real magic.
If the target of the spell is unaware it has been cast then there is no cause/effect relationship. If it appears the spell works in such an instance it is by pure coincidence or biased interpretation. Furthermore, if an impossible spell is cast--such as a spell to allow someone to fly unassisted--then nothing will happen, even if the target person is aware such a spell has been cast.

And no, they don't defy the laws of physics. Magic is not an easy way out, nor will it change what you've already set in motion. Actions work much better.
