My fiance was involved in an accident where a dump truck hit her driver side. Her car is prob. going to be totaled. She isn't seriously hurt, but did go to the doctor for her back. What should she do in order to make sure that she is compensated for her accident. I am not saying we want to make money off of this wreck, but her time missed from work, doctor bills, etc. need to be paid for. No experience with a wreck at all, much less involving a DUMP truck, so what do we do???

The insurance company was informed of the accident, and the police was called to get a police report. Someone was saying that if we want to get compensated for medical bills and time missed from work that we have to basically hire a lawyer. We don't have the money to do all of that! And that if she wasn't seriously hurt, then we prob. wont get anything.

Here are some facts that you need to know, and decide if you need a lawyer or if you can handle this on your own.
Adjusters will frequently offer two-thirds or one-half of the demand received from the plaintiff's attorney.
A local claims manager has about $50-100,000 discretionary settlement authority. He will usually extend $20-30,000 discretionary settlement authority to his claims supervisors, and $10-15,000 to the office claims staff.
The prudent plaintiff's attorney will ask the insurance company point-blank, in the very beginning stage of the relationship, “Are there any coverage issues? Are there any liability issues?”
“Avoid Monday mornings and Friday afternoons as this is the busiest time for adjusters. These are the times they will be least receptive to attorneys’ phone calls or requested meetings.”

contact the company that owns that dump truck, get in contact with a person(s) who handles the company insurance. Any illegality of this accident should be recorded with the police. Have any sort of legal documentation with you when you get into contact with the person(s) for reference purposes. At no point in time on the phone call should you ever admit fault, be convinced you were at fault, or have the fault pushed over on someone else. Don't be afraid to be firm and blunt with them, lives were at stake because of there driver's mistake. You are the victim and should be compensated

Have you hired a personal injury attorney yet? It is always in your best interest to hire a lawyer before you talk to the other vehicles' insurance companies. This will protect your rights and help you get the compensation you actually deserve versus what the insurance companies think you deserve.

You need to contact a lawyer. There are many accident attorneys that will only charge you if you collect, usually about 33% of settlement. If you try to contact company on your own they will not compenstate what you deserve. Your insurance company will usually only subrogate their losses.

Like the other poster above said, document everything (pictures, etc.)
And then let the insurance company take care most of it.
Good Luck.

your ins. carrier should do the leg work for you, but your best bet for a fair settlement is to hire a lawyer. Ins. co's typically offer 1/3 of what your claim is worth.

Contact your insurance company. They will contact his and get money from them.
I hope you got all of his info.
They should cover repairs, and doctors bills, you will be lucky if they cover lost work time though.
