Had the surgury on thursday last week, went back to work tuesday, i left early on wednesday, and i have an infection from the surgury that makes me feel awful. I called in today and the boss said "dont feel bad when yo don't have a job anymore". i told him he couldn't fire me, i said i have a Doctors note. They cant fire me could they? We have FMLA plus I have a note from Dr.

with a note from the doctor, they cannot fire you for this absence, but if you have had more absences than is allowed for in their policy, regardless of the reason, they can indeed fire you.

If you aren't currently on FMLA you can be fired from your job. Most states are right to work states which mean employee really have no recourse in losing there job. Check to see if your state is a right to work state and see what rights you have as an employee. If you have a union at work you should consider joining! Best wishes and I hope you feel better soon!
