If he files a joint return with his soon to be ex, then you can't claim him.

If he doesn't, and IF he lived with you all year, and IF his gross income for the year was under $3400, and IF you provided more that half of his support for the year, then you might be able to claim him. But if your relationship violates and local laws or ordinances, even if they aren't enforced any more but are still on the books, then you can't.

Yes, if your bf does not file joint return and his income is less than $3,400, and lived with you all year. And, your state is not North Carolina, Mississippi, Virginia, West Virginia, Florida, Idaho or Michigan.

Nope, cannot claim him unless you adopt him and he is totally disabled. Otherwise, you need to be married.
