My brother-in-law recently started as a police officer in my city. There was a report on CNN about the possibility of the draft, and he said that he couldnt be drafted because police are considered part of homeland security. Is this true? i believe the part about not being drafted because they are providing a service, but wouldnt you have to be a federal officer to be considered part of DHS?

thanks for your help in advance.

No, Homeland security is a federal agency, with federal authority. Your brother in law is part of municipal government, and his authority is granted by the city charter and state law.

I am not aware of any laws preventing him from being drafted.

My understanding is that a dept can be deputized as part of the federal agency during a crisis, but it is not automatically part of it.

There isn't any exemption for police officers in the draft, but keep in mind that the regular military, national guard, and state defense would probably all get deployed before a draft was put into effect.

Local police play an important role in homeland security, but are NOT part of DHS, which is a Federal Agency.

I know a lot of the guys my boyfriend works with have been deployed. But they are already in the military. My boyfriend was also a marine... Thank God he didn't re-enlist.
