I am wondering at this point if it will really matter. Do you have a refund coming? Have they written to you about the missing tax return? I know nothing about IRS law, except that if they haven't missed you by now, maybe they wont.

While you can't get a refund, you should still file if there is any chance it looks you might have owed if you filed as single with a standard deduction and no other writeoffs.

For example, let's say I normally claim a few dependents and itemize mortgage interest. With those I don't owe tax and would have gotten a refund. I forget to file and knowing that after 3 years I can't get a refund, I don't file at all.

Then I file for 2007 and it looks like I'll get a huge refund. Guess what, the IRS may flag my account over the missing tax return and won't give me my refund until I file it and they take their usual 6-8 weeks to process it. Or worse, I owe and the IRS won't grant me a payment plan because of the missing return.

If you do not have your W-2s or 1099s, you can call IRS at 800-829-1040 and request an Information Returns Transcript and they will mail it to you.

You can file for 2001, and can download the forms at irs.gov

If you had a refund coming, it's too late to get it.

Get what? You need to file and mail it in. Talk to an accountant. There may be alot of penalties. Don't ignore it...they will catch up with you (IRS)
