Yup. He is.
Take your mom out to lunch and whatever else... have a talk with her... ask her if he is verbally or otherwise abusive to her.
You can call elder protective services and have him thrown out, if needed.
After that, I would suggest changing her locks.

He could be a jerk or a cunning schemer.While living with your mom, may be he is syphoning off the savings of your mom.If this is the case, he will try to ensure that no other relative should intrude in the family and make your mother see the reality.His rude behavior is meant to keep you away from her.
You should visit her in person and make your own assessment. As a daughter ,it is your duty to see that her interests are well protected.

Yes it is. He doesnt have to be like that he could just say call her back. But since you are his sister then he probably feels he can be like that. Given he is 40 years old he shows alot of immuturity i would say. That still is your mothers phone since he lives with her so maybe just tell your mom that you didnt like that.
