ok so basically my husband just got out of jail about 4 months ago, he was in for not completing his community service, and was sentenced 20 days but was let out after 2 weeks. so he got a 3 year probation, and suspended license until january 2008. anyways he had asked the judge for, (i think its called a wokers permet) which allows him to drive to work and back only, but the judge denied his request. so we couldnt just wait around till january for him to start driving legally again and i dont drive, we have 2 kids and one the way so money is a definate need and we are both only 20 yrs old so everthing in our lives is hard right now.

well to finally get to the point, my husband got pulled over for no reason at all and was charged for driving with suspended license, no registration, no insurance, stolen sticker,(which was not really stolen he bought it off of someone), and 2 misdumeaners. he has till january to appear in court, how long do u think they will sentence him, in CA?

o yeah if we hired a laywer could that shorten his time or is is just a waist of money??

You need to hire a lawyer for sure. If you cannot afford one apply for a public defender.

Typically those infractions would merit him a short visit to the county jail but since he is on probation he gets special treatment so to speak as the terms for probation are you do not violate any state or federal laws and in this case he did. The courts are not interested in the reasoning behind him driving, IE supporting his family, they are only interesting convictions. Contrary to popular belief they are NOT out to help anyone but their own court records. But get and attorney and try to get house arrest so he can work to support you guys.

From what I understand, he could be, depending on the judge and court (i am in Missouri so this may be different in California) he could be placed in jail for up to four years. 3 for violation of his probation while also having stolen property. If he bought the sticker off some one and it wasn't registered to his car specifically, it is still considered a stolen deal. It maybe less, california law is alittle strict so that is my estimate, in Missouri I know, he would at least get 6 months to a year for the stolen tag alone since it his second offense I assume.

Who knows but if he has a wife and two kids I would think that making a point like that was selfish and inconsiderate of him. You better learn to drive soon or get a buss pass because he might be gone a while . The judge will not let him off so easy and he might not have a license for a year or more after he gets out.

I don't really think a lawyer can really help. No license,reg,and insurance,and stickers that he bought off the streets big no no and 2 misdumeaners that judge going to look at him and book him. He will be gone for a quite a few years you better learn how to drive cause your going to need all the help.

He may spend a few weeks in jail for the two misdemeanors, depending on what they were, but not for the other things. The jails are too crowded her for anyone to be sent to jail for things like driving on a suspended license or lack of registration.

3 years probation?? I hate to tell you, but he could be in jail for a while! Doing what he did is not much more than giving the judge the finger., so don't expect much in the line of a break.

Probably until he (and you) figure out that the laws in this country and your state DO actually apply to everyone and that means you too.

If he doesn't start obeying the laws it won't matter how long his sentence is, because he will just be going right back in when he gets out.

What a mess. I do feel sorry for your children. They deserve grown-ups for parents. You two really need to grow up FAST.

ca sucks, thats why i moved to montana, anyways he is in big trouble, buying a sticker is just like stealing because you knew it was'nt legal, breaking probation is even worst, the judge might come down hard depending what he did in the first place, and on top of it all, its his word against a cops.

being young, having a hard life, needing $$$$ ect... these are not things that will excuse you or anyone else from breaking the law. Laws are set for a reason!!!!
